this really kinda helps the rsc's in my opinion, it'll make people a little more willing to add a text package to their plan. but as a consumer this sux, they are trying to spin it by saying that it's that way with sprint, but you have free incoming with sprint so that logic doesn't really work

man what's gonna be next? first it's 7-7 that they bump up to 8.99 then insurance goes up to 4.99, now ppu text goes up 5 cents. should make it a little easier to sell the 200 text package, but i can still see some angry customers coming in who dont read their bill and getting hit with the new pricing.

Hey if sprint charges .15 and they get free incoming then maybe cingular will go with free incomming as well!! I could go for that.

Sprint does not have free incoming sms...not last I checked anyway. They do charge .15 per message now though. I had someone tell me that sprint broke their contract by raising that price...

This company is a joke....they are trying to squeeze money out of everything...I dont get the hire up's at all, I get so many customers complaining of the high cost of service, and I don't blame them....I personally think that we are kinda pricey as well. It would be nice to see Cingular adopt some of the customizable plans and policies that the major European carriers have, such as Vodafone and Orange.

Yeah Sprint let people out of their contracts with no ETF for a while due to their change in PPU text charges. I wonder if Cingular's gonna have the same problem?

I am not a lawyer, just a bored salesman with a copy of the cingular T&Cs here but they say:

Page 6 - Changes to Terms and Rates:

If we increase the price of any of the services to which you subscribe, beyond the limits set forth in your rate plan brocure, or if we materially decrease the geographical area in which your airtime rate applies (other than a temporary decrease for repair or maintenence), we will disclose this change at lease one billing cycle in advance (wither through a notice with your bill, a text message to your equitment, or otherwise) and you may terminate this agreement without paying an early termination fee or returning or paying for any promotional items, provided your notice of termination is delivered to us within 30 days after the first bill reflecting the change.

The clause looks very similar to the one that allowed Sprint customers to escape their contracts. I suppose interperiting it hinges on whether pay per use SMS is considered a part of the 'service to which you subscribe'. If you use pay per use SMS you should be able to void your contract with this, those who have a messaging bucket may have a harder time.
