Well, I looked at the feedback and here are my thoughts. Yes, the guy has a 300+ rating, only one negative. But, if you look at what he has sold previously, you see it's only gun holsters for $20 and stamps for less than $20. It takes a lot of work to achieve a 300 rating. But, if this were a scam, he will easily obtain $7000+ from this deal. For me, that's a lot of work to scam not so much. But, that's just an opinion. On, the other hand, $569 sounds pretty cheap. Also, the picture is not of his phone(s), but of a seemingly German picture, most likely from a Cebit or something (carrier on the phone is D2).

Personally, as tempting as it sounds, I don't know if I'd gamble $569 against $150 extra or so (which is the extra you'd have to spend from someone reliable) to maybe have problems. Why don't you ask him to e-mail you a picture of one of the actual phones you'll be receiving, or an IMEI number, so you can check the validity with SE.

Truth be it told, if someone came to me right now, and offered me 12 pieces at $569, I'd grab them all. Therefore, I think maybe it's a little too good to be true at this point still.

Just my 2c ... Good luck

And, XP, why did you SELL your P800? Don't you know that's illegal on this forum to admit this unless you have a backup one?? You should be punished !!!!

Posted by: CameraAssistant

The ebay description says he accepts credit cars, but I do not see a link to PayPal.

I figure there is nothing to loose if I pay through PayPal with a Credit Card.

Right?

You’re better off paying with a credit card directly - I don't think Paypal offers much protection on international purchases. FYI - I emailed this guy a couple of questions yesterday and haven't heard back from him yet. Also, all pics used in the auction are stolen from a prerelease review - makes me question the legitimacy...

NEVER use western union to pay someone. that's a reason to say no right away. you will have no chance of getting your money back if you do it that way.

Posted by: jeffharris

Aside and beyond the Western Union, the fact that the seller said they're in Canada, and they want a wrie to Germany, is a red flag.

I BET YOU this legitimate guy from Canadas E-Bay account was "Hijacked". It has been happening rampantly, where a hacker will get into the E-bayers account, and can change the password, and in effect, "hijack" the legitimate users account, and keep the real user out, so they can't stop it. The hacker will even reroute the registered E-bay e-mail account, so when you send an E-mail to the seller, it is routed to the thiefs e-mail address. It's happened to 2 of my friends. And, although E-Bay tries to some level to protect you and help yo uunwind the problem (which also includes some obvious, but untrue negative feedback, as a result of the hacker stealing), E-bay are not too helpful, and it makes this type of theft very difficult to straighten out.

Posted by: jeffharris

Or, as a "test", call his bluff -- I actually will be in Munich the weekend after next. I looked at my GPS app, and his address in Munich is a legitimate one. Tell him that you have a friend (me) that will be there in 10 days. Can I come by his address, and buy all the ones he has left, for $569 cash?

i am not buying the item, because first i do not pay with western union, second i will not send a big amount to germany, and this is called miss leading information on your part so if you want me to buy the item you can have it shipped to me COD.
thanks.
so he responde with the following:

Dear Customer,

We are not set up for credit card acceptance like a
regular business would do. We have to enable our
internet merchant account in order to process your
credit card online or over the phone.
This will be available in 3 weeks from now on. Paypal
payments are not available because we lost 2 items
shipped to Indonesia that were paid with stolen credit
cards.Paypal processed the credit cards and we shipped
the units. That was our loss.

We will only ship after the payment is done.

Thank you for understanding
--------------------------------------------------------------------------------

thank you guys for the advice.
i only blame my self for selling my p800.

Posted by: jeffharris

I've spoken to the higher ups, and we forgive you for selling your P800 -- you may stay in this forum

The nice thing is, for a smartphone, it is really the "dumbest" phone I ever had. I can backup mine, take another one, and in one shot, make it a clone of the prvious with a restore. This has to be the easiest phone to "clone" the internal info, and not have to manually enter settings, I have ever had.

It's a scam.

All the warning signs are there:

- says takes credit cards, money orders, etc.
- does not say "only western union" anywhere in the auction.
- Lists a Canadian email addie but wants money sent to Germany
- Auction ends, demands wired money only(almost impossible to get back, even if you use a credit card)
- previous sales by dufrost have nothing to do with hi tech gadgetry.

Here, from the auction are the payment details;

Payment Intructions:
Payment MUST be made within 5 days of auction closing. Please only bid if you are serious and intend to purchase the item if successfull; we encourage first-time ebayers to participate; and will work with you to make your first buying experience a positive one.

"we will work with you to make your first buying experience a positive one"!!! Yeah, as they rip you off and make you swear off eBay before your first purchase is completed!

Western Union moneygram demands to a foreign country are almost always scams. I would contact eBay and tell them you suspect this is a scam, and want to defer paying for it (and not take the knock as a non-payer) until they can verify that it is a real deal. You may want to raise the spectre of 'highjacked account" based on the positive feedback.

I feel bad for the original "dufrost" guy who almost certainly has had his account hijacked. He developed a good eBay account for sales of RCMP nostalgia stuff.

i wrote ebay last night about the transaction and explain that i am no longer want it the item and explained that the seller was missleading information in his auction and that he wants me to pay with western union so ebay responded with the following:

1st email:

Thank you for writing to eBay's SafeHarbor Department about a
transaction you do not want to complete. We understand your concern and
will investigate this situation as soon as possible, usually within 24
hours.

We understand that there are situations when a member may not feel
comfortable following through with his or her bidding obligation.
However, under most circumstances, when a member places a bid, he or she
is committed to honor that contract and follow through with the
transaction.

In order to not complete a transaction, you should get the approval of
your trading partner, because a seller can release a bidder from a
buying obligation. The best thing to do is contact your seller, explain
your situation and come to an agreement that benefits you both. You can
request contact information for a trading partner at the following web
address:

http://cgi3.ebay.com/aw-cgi/eBayISA...how#ContactInfo

We hope that you will be able to resolve this situation with your
seller. However, if you cannot, we want you to be aware of the possible
consequences.

If a bidder fails to complete a transaction when her or she has won an
item, the seller may file for final value fees and/or leave negative
feedback. When both parties agree to not complete a transaction, a
seller can request a final value fee on that basis and it will not
negatively affect the bidder's account. But if the seller indicates
other reasons for the transaction not being completed, the request for a
final value fee credit will generate a non-paying bidder infraction
against the winning bidder's account. Non-paying bidder infractions can
lead to the suspension of an account. You can read more about the
Non-paying Bidder Program at the following web address:

http://pages.ebay.com/help/community/npb.html

If your trading partner has become 'not a registered user', you should
think carefully about completing the transaction. We recommend that you
avoid transactions with users who are no longer registered. Feedback
cannot be exchanged while a member is not a registered user. If there
has been questionable activity by your trading partner, we would also
advise you to use your best judgment.

We appreciate the time you took to write to us and wish you well in
successfully resolving this situation.

Best regards,

eBay SafeHarbor Team

2nd email:

Hello,

Thank you for writing to us with this information. I am sorry that you
are having problems with this transaction.

As the Seller has become "not a registered user," it is up to you
whether or not you decide to complete the transaction. However, eBay
does not suggest completing a transaction with an unregistered Seller
because of the potential for problems.

If you're unsure about the Seller, then it would be best if you choose
not to complete the sale. If you decide not to complete the sale, you
may want to email the seller and kindly explain your decision.

On the other hand, if you decide to complete the sale, you will be
covered under eBay's Trust and Safety policies. You may view these
policies in detail in our Rules and Safety pages at:

http://pages.ebay.com/help/community/index.html

However, you will not be able to leave feedback while the Seller is
unregistered. If the Seller's account is reinstated within 90 days of
the end of the auction, you and the Seller will both be able to leave
feedback on the transaction. If the Seller's account is unregistered
more than 90 days past the end of the auction, neither you nor the
Seller will be able to leave feedback.

If you receive feedback from this Seller you feel is unfair then please
review our feedback removal policy at:

http://pages.ebay.com/help/community/fbremove.html

Please understand that I am unable to provide reasons why this member is
no longer registered. Also, I can't disclose information about whether
they will be back on the site. However, if you are still unsure about
what to do in this situation, you may want to take a close look at the
member's feedback and see if there is any cause for alarm. If the member
has numerous negative comments, then you probably would not want to
complete the sale. Of course, the final decision is up to you.

I truly hope that the information above is helpful in allowing you to
find resolution in this matter. Good luck with this and all of your
future eBay activity.

Regards,

Kendall

3rd and last email:

Dear xpmillinium(xpmillinium27@aol.com),

Please be advised we have recently ended all listings for the seller 'dufrost', as it appears the account has been compromised and used by an unauthorized third party. The account may remain suspended for a time while the incident is reviewed further.
Under these circumstances, we advise that you do not complete the transaction, which can be considered null and void. If you have already sent payment, please cancel if possible. Stop payment through your bank if you paid by personal check. If you paid for this item with a credit card, contact
your credit card company's security department to inform them of the potential problem. If you have made a payment by money order, please contact the issuer for further information. If payment was sent via Western Union, contact them by calling 1-800-325-6000. Money Gram inquiries should be
directed to 1-800-926-9400.

I'm really glad you didn't get scammed, but know this...the answer to the question:

"I figure there is nothing to loose if I pay through PayPal with a Credit Card.

Right?"

is NO NO NO!!!

American Express does NOT provide ANY protection if paying with Paypal. Currently, Mastercard and Visa do. HOWEVER, I have been told by reps at both places that they are considering NOT providing protection b/c of how much $ they're eating as a result of ebay/paypal scams.

Think about it - what credit card buyer protection means is that if the customer (you) disputes a charge, they make the seller eat it. However, in this case Paypal is not legally the seller (i.e. is not the merchant) - they are just providing a service.

Check out paypalsucks.com for lots of info on how scammers use it. And IMO, it does suck.

And eBay only gives you $175 for a 'successful' claim...AND it must be filed b/t 30-60 days after auction closes. Sometimes it's hard to get the necessary proof in that time (including a report that you were negged by your credit card company when you tried to get relief from them).
