Getting a new phone

Currently I'm on Cingular, with a Razr V3, but it's cracked and it's a bad phone to begin with, and I'm thinking about getting a new phone. Am I correct in assuming I can just buy an unlocked phone (off eBay or somewhere else) and put my sim card in it, and be on my way without having to notify Cingular or anything?
