PEBL voice dial with headset problem

I'm not sure if this is an isolated problem on only my PEBL, but I've been unable to find anything about it.

I am attempting to use a Motorola H3 Bluetooth headset with an unlocked PEBL from motorola.com and am having problems with the speaker independent voice dial system.

The ObeyMOTO (I think that's what it's called) recognition software works great, but the problem lies in attempting a new voice dialed call from the headset when there is an alert present ("n Missed Calls," "n Voicemails," etc.). When no alert is present, a press of the button on the H3 yields a beep from the headset and a prompt from the PEBL: "Say a command." With an alert present, the beep from the headset is heard, but the software never prompts for a command.

Also of note is that when an alert is present with the flip open and I press the Voice Dial button on the right side, the "Say a command" screen does not come up. When the alert has been cleared, another press of the same button opens the screen.

A press and hold of the H3 button dials the last dialed number. This works whether or not there is an alert present.

I used the H3 with a V3 originally and never had this problem. The V3 did not have the ObeyMOTO software, but had to be trained with each phonebook entry.

Any input would be greatly appreciated.

As a side-note, is there any way to change the ringtone heard through the headset when the phone is set to vibrate?

from bottom to top:
As a side-note, is there any way to change the ringtone heard through the headset when the phone is set to vibrate? this is standard moto behavior - when connected to a bt headset they play the default ringtone - usually continental.
Also of note is that when an alert is present with the flip open and I press the Voice Dial button on the right side, the "Say a command" screen does not come up. When the alert has been cleared, another press of the same button opens the screen. press the button once clears the alert - press again brings up obey moto - as far as i know this is standard
- i know sometimes i have issues using a headset, but i haven't paid attention to why, so i'll have to check out the other two items
