Questions about activating a used iphone?

Since the price drop in the 8gb iphone I'm considering getting one and giving my 4gb to my fiancee. Now, how will this work?
Will she be obligated to signing a 2 year contract? That doesn't seem right because the phone has aleady been activated that way, so it's now used. I wouldn't think that everytime a iphone is sold, the person buying the used iphone would have to sign a new 2 year contract.

Why not call ATT and ask? Because they're greedy and they have a monopoly on this phone, I would bet they make her sign a two year as well...
