If you have an unlock iphone and you update to new firmware 1.1.1, is it really a brick if you don't try to unlock it again? Can you still legally activated through itunes and open a contract?

I would say no, it's not a brick. The way I use the word brick is that it can be recovered (though, not by you). You just need an Apple Genius to remove this problem from your hands (flash). Though I guess now that I'm typing it, it does sound like it's bricked if you can't fix it yourself and need the corporations help to get it running again.

Yes it's a brick

Until/Unless either
A: Apple becomes more tolerant of repairing (even if fo a fee) the new paperweights
B: The iPhone Dev team finds a way to reflash the baseband radio ourselves
