cingular 8525 question

so i have an awkward question. My friend of mine has gotten a hold of phones that I think are stolen. He is selling them for a severely discounted price and I want to buy one. The thing is, can cingular track the imei number on the phone and attach it with my sim card??? I dont want to get in any trouble if this is the case...any input would be appreciated.
