8gb Iphone on sale for 399.99

The 8gb iPhone is on sale at The Apple Store online... It says you require a 2 year contract but I spoke with an Apple Representative and was told that you do not have to subscribe to purchase.... But the phones will not work until you do...
My question is, can these phones be unlocked?

if it's 1.1.2 then no they cannot be unlocked. If it's from Apple.com there is no way of telling what week model they are so you're better off not trying to purchase one.

ebay or craigslist are the best spots. good luck getting one for under $500 though. You can also go into a store and ask for the correct week, but they'll probably look at you strange and ask you to kindly leave the store

i was right you can always use the bogus line that others have used and said you know of the issue with the faulty screen and tell them you want a pre 45 just to be safe. You might get one of the ignorant helpers that will run to the back and look for one

Not true. When you place the order, the serial # shows up, so you can check it that way. You can then refuse shipment, but that doesn't really solve the problem.

However, there's about a 99.99998% chance that all iPhones ordered from Apple.com will be a Week 46+, unless it's a 4gb refurbished.

how does ordering online work right now anyway? I need to get 10 phones for my relatives overseas, and they're willing to wait for the unlock. Can I order 5 phones on each card but have them sent to the same address? Can I go to the store to get them? How would I go about doing so?

No. Apple limits purchases to 2 per person (meanng two per credit card.)

Geez... SEARCH! That's been covered in a gazillion threads and is in several stickies. Try looking first, because there's a high probablity your question has been asked and answered (and in the case of the week #, yes, it's been weel documented already.)
