Sorry meant to say the seller has the phone sealed and doesn't want to open it. It there a way I can tell if it can be unlocked or not?

Week 44 is unlockable 99% of the time. You should be fine, but without opening it there is no way to know for certain.

ok so once I open it first thing I should check is the firmware right and if it is 1.1.1 or lower I should be able to unlock it??

Correct. I believe the code to check the firmware is *3001#12345#* call. Also, if its 1.1.2 the slide for emergency will change languages.

Week 44 is, by my guesstimate (from what I've seen & read) 95% unlockable, depending on what plant it came from (some of them were already pre-loading 1.1.2/4.6 BL on them.) Regardless, I'd still buy it and take the risk.

Buy it, open it, and then go to UnlockThatiPhone.com and follow the instructions to check the phone, and unlock it (provided it's 1.1.1.) No PC needed for 1.1.1, just a WiFi connection.
