Please help I think I got Screwed

i havew never purchased a phone from no where but the company, but i really wanted a new phone and i founded a katana 2 on ebay and i brought it. the seller had many katana's to sell and he had exteremely high feedback ratings. well i got the phone today and i tried to activate it and i can't the esn number is in use. sprint said the will release the esn on the 21 if everything check out. if it doesn't then what should i do. i have a square trade warranty, does that qualify for reinbusement? i tried to contact seller but he won't reply he says that he reinburses for doa, does that qualify? can ebay do anything since its with in my 14 days and it is not as advertised.

if the guy didnt say anything about this in the auction i would hurry up and file a claim with paypal and get your money back i wouldnt even mess with this it seems shady. Can you post a link here for the ebay auction. If you paid with a credit card id call for a chargeback.

I think you will be ok on the 21st. I don't see what would cause them not to release it. It's not stolen and you are the new owner.

That phone is pretty low end though. Doesn't have any of the sprint goodies or evdo. I mean hell, if you're gonna be on sprint you might as well take advantage of what they have. Sprint tv and evdo. If you like the katana get the dlx. Toss opera mini on that baby and browse the web with evdo.

thats the link to the sellers acution i got it from. okay i will wait for the 21st since alot of customer service and account services reps went to bat for me. i hope it works. so you are saying that the katana 2 isn't a good phone

Irrelevant. Sprint will NOT release the ESN's for activation IF:

* There is a past-due balance tied to those phones or the account on which the phones were most recently active.
* An ERP insurance claim has been filed on the phones.
* They were reported lost/stolen by the previous owner. (The previous owner will have to call to have it cleared up.)

Note that in many cases someone misplaces a phone and has it temporarily shut off, and Sprint will flag the phone as lost/stolen. When the phone is found the owner calls back in to have service restored and Sprint does this, but the CSR handling the call doesn't completely clear the lost/stolen flag on the device, which would also prevent a future owner from activating the devices (and also requires the original owner to call in and straighten it out).
