Warranty question (a little confused)

My questions is basically simple, I have a TyTN that I purchased off of Ebay (it was a Rogers TyTN - mobile provider in Canada for the people who don't know). The person who sold said it still had 8 months left on the warranty.

According to HTC's website it says I have a warranty until August 5th 2008.

Now my question is am I covered under warranty from HTC? I am wondering because I did NOT originally purchase the phone and I got it off Ebay?

Any ideas?

p.s. I ask because I am having issues with it regarding this HERE. So If I am still under warranty I will send it in or else I will give the DIY repair way a shot.
