Is my new iphone 8GB refurb jailbroken?

Hello everyone,
I just joined the iphone world(actually bought for my wife anticipating epocrates) and when i was playing with the iphone, noticed that right out of the refurb box(from AT&T) that I could join my wireless home network and that I could surf the web on Safari and watch Youtube videos. The Ipod functions seem to work as well.

So, is this phone Jailbroken? If it is, how can I tell if it is unlocked?
The phone has Software 1.1.1 on it.

I really did not want to deal with the warranty hassles if it is unlocked and I need to return it (we are AT&T customers, so unlocking is not needed)

I've read about some of those refurbs coming direct from AT&T have been already Activated (which is what this sounds like), nothing about Unlocked or Jailbroken.

Is there an installer app on the main page? try another company sim card besides at&t to see if its unlocked.
