Class Action Suit anyone?

I know a few attorneys that purchased iPhones. I wonder if there are any of them willing to start class action litigation against Apple? It seems like this is a well thought out strategy. They sold all of us willing to jump in right away. Now the enticement to those who waited is to say to us, "I told you so". Next, ATT will bump up the monthly data fee from $20.00 to what ever. I will still enjoy my "devalued" first gen iPhone but no more bites from the sour Apple.

This has to be the dumbest thing I have ever heard.

No one put a gun to your head and forced you to buy an Iphone.

This coutry would be a lot better off if people actually started taking responsibilty for their actions and not run to the courts and expect the government to give them a handout.

I don't even see what the claim is.

If you bought a 2G iPhone nothing has changed, other than you'll get some new software *free* around July 11. Your existing contract will remain.

If you want to buy a 3G iPhone, you can, at a lower price, but with a new contract with higher monthly service fees.

Your choice.

While I'm slightly ticked off about the plan changes I think this is ridiculous.

Besides you really have no case ... if you have a current iphone nothing will change as long as you keep your current phone.

Hell. I'll sue toilet paper manufacturers for making better, softer toilet paper leaving my 1-ply un-quilted toilet paper uncompetitive.

A class action suit, for what?

When you buy a car or dishwasher or other major appliance, can you go back and sue someone because you didn't get the same price as another consumer?

If you purchase something, then you have essentially agreed to the pricing at the time of sale. Yes, some merchants offer a 30 day pricing guarantee for the SAME product. In this case, it is NOT the same product.

I am really fed up with people whining about their purchases and feeling like they have been cheated.

This thread is ridiculous.

Funny, everyone wants their technology and the US is SO FAR behind in it. WHY? These companies can not develop what they want as they have to pay all these lawyers for all these class action lawsuits and patten infringement suits.

I actually do see one coming, but not for the reasons above. When you buy the new phone and activate it your current phone (that you bought and paid for) will stop working and you won't be able to swap your sim into it as a backup phone. It'll be a brick with an invalid sim message and no way to activate it.

Technology always changes, and yes Apple doesn't advertise in the Wall steet Journal that they were coming out with a 3G phone, BUT If you did ANY research online before plunking down $300+ for something wouldn't you spend an afternoon researching about that item being obsolete anyime soon?

If the OP's comments were directed at the increase in data, AT&T has always had different prices for 3G and non 3G devices so a lawyer will just laugh at you.

When you agree to the two year contract you are agreeing that the phone you are about to recieve will be used on your plan. If you want to use your old one as well, then you need to open anothe line. This is pretty much common sense.

We just live in a sue-happy world where if there is something that we don't understand or think is not fair, we just blame and fire lawsuits and people or companies. The opening poster is probably one of them.

What? New iPhone 3G? DAMMIT! I have a 2G iPhone and one year later there's a newer and better one?!?!?!?? WHAT WHAT?!?!??!? Now I have to pay to get the new iPhone 3G when I already gave Apple/AT&T my money?!?!?! I'm gonna $ue!!!!!!!!!!!

Wrong, anyone can buy a current 3G-capable 'regular' phone (say the LG Shine) and use a MediaNet Unlimited plan just as much as anyone can buy a EDGE-only 'regular' phone (like the Sony Ericsson 580i) and still be paying the same price for data.

It sounds like AT&T is classifying the iPhone 3G separate from even the first gen iPhone for data plan purposes. It doesn't even sound like it's classified as a PDA, since the data plan pricing doesn't match up, so the iPhone's in a category of its own... again.
That's the issue.

AT&T isn't raising the price of the iPhone data plan, it will still be $20 and may always remain so.
They are only making it $30 (+text messaging plan) if you buy the new 3G iPhone.

So you only have to take the price hike if you upgrade and pay the same PDA data plan charge all other PDAs, smart phones, and Blackberries pay.

AT&T made a big mistake by offering the first iPhone data at $15 ($20 includes $5 sms.) If they had introduced it at $30 like I expected they would it wouldn't be pissing people off.

I used to for a certain fruity computer company and we would get calls ALL the time about people who bought a certain phone and were pissed about the prices being dropped, or the storage changing and they felt they were fully in their right to get their phone swapped out for a bigger one, or get a discount.

I did not advocate a class action nor would I get involved in one. However, a little old lady collected almost 1/4 million for spilling hot coffee in her lap while driving. People that smoked cigarettes well after it was determined that smoking was a cause of cancer collected millions. Gun manufacturers are being sued because criminals shoot people. Law suits with much less of a valid reason have been successfully pursued. Today an Attorney filed a suit against OPEC over oil prices. That being said do you think it is not a possibility?

No its not a possibility... how was the OP harmed? Besides, filing a suit and winning a suit are two very different things.
