What if I "activated" an iPhone that had never been activated after May 27th

Like the title says, I purchased a spare iPhone in March 2008. I never activated the phone. I ziphone/hacked the phone, gave it to my brother to use on Tmobile.

Now since I'm not "eligible" for an iPhone upgrade my brother is giving me back the iPhone for the next four weeks and I will properly activate the iPhone on
my ATT account.

So a couple of questions and this may be a little complicated.

1. I originally purchased the $600 iPhone on June 29th. I legally activated that phone but than canceled my iPhone data plan and went to the media max plan because I feared I would lose my FAN discount. I sold my original iPhone last month in anticipation of the 3g iPhone. So currently I'm using a Moto Q 9 that I purchased in Feb 2008 and my account says I'm not eligible for an upgrade. Question is since I had brought the iPhone on day one but I sold that iPhone and never had a legal iPhone plan, do I still qualify for the upgrade price?.....if the answer is no....than consider number 2

2. So if I am no eligible for an upgrade by the above method, once I get my brother's hacked iPhone, I will unhack it and legally restore and reactivate the iPhone under my ATT account. Would I than be eligible for an upgrade?

My ATT status says I will not be eligible for an upgrade until Nov 29 2008.
