LG Incite with $10-15 data plan?

Hi, is there any way to use an unlocked LG Incite with one of the MediaNet data plans? I am aware that AT&T is requiring smartphone dataplans with smartphones now, but can one still register a non-smartphone IMEI with ATT and then swap out the SIM card? Is the rumor that ATT does witchhunts for IMEIs now confirmed? If so, do they really just automatically upgrade you to the smartphone data plan if they find you out?
If because of that, there is no way to get even a greymarket Incite without being upgraded to the $30 data plan, can you please advise me on what phone to get instead? I lost my subsidy LG Vu with a $10 family data plan. I'm looking for a thin whole-phone touchscreen, 3G "emergency" tethering capability, and good YouTube access, all of which I had with the Vu. Writing texts is not very important. I'd like to also have a good IMAP email interface,, and free access to Pandora radio, which were frustratingly out of reach with the Vu. I like the old-school Windows Mobile OS, which I got used to using a Dell Axim back in the day, so coming back to that would be good. Newer Windows mobile would be great, too. I checked out some HTCs at the AT&T store, and found their screens to be absolutely beautiful, but they loaded web pages very slowly and kept freezing up. The Incite loaded WAP pages briskly. Ultimately, I'm on a budget - would like to spend no more than $200. Does anybody have experience running a Gigabyte GSmart with AT&T in 3G with tethering? Is there anything similar to the Incite in the TMobile or regional carrier world?
