After only (yes ONLY) arguing with the so called 'tech' for a half an hour over if it was even broken, he finally agreed to run it though some 'tests'. When I returned in the 30 min time that had been requested, I was greated by the manager who said they would be promptly shipping me a new one. New phone works great! (for now)
