Well, I called bestbuy hoping my plan will cover an exchange for my phone but that didn't happen. Since the plan is inclusive of the manufacturer's, they aren't going to replace theirs so they forwarded me to a Cingular rep. Already, my hopes were going down the toilet....
BUT, it worked! The guy was nice and I told him I tried a hard reset, set the profile to outdoors and volume raised up yet the earpiece and mic was low. Few minutes later, he told me he is shipping a replacement Mpx220 to me. Yes the mpx not the v220. He even mentioned, oh that's the data phone isnt it?
I'm not too happy yet since I will have to check if it's the new firmware version, but at least there's hope that CIngular knows what this phone is now.

In a nutshell: The replacement is the updated version, rest easy.

Yeah, I got the phone today and the version is 1.3. I can't say I notice a huge difference but I also noticed I didn't have to position it as well as I used to. It is still not loud enough IMO. The speakerphone is either the same or a little bit lower. The mic however, seems to be a good improvement. I can't really say for sure but one of my friends who barely heard me on my last phone said it is a louder than usual.
Ah well. Still a better device than any other phone since I enjoy variety.
