Unlocked MPX-220 from Amazon?

Do the phones from Amazon (that say MPX-220 Cingular) actually come SIM and DATA unlocked? It's $399 for the phone without a plan so want to make sure I can use it anywhere. Also, any chance it would be the 1.3 firmware? And if not, is there any way to flash the phone without sending it back? Thanks!
