ok i just tried it the nice way, with csr xbm, told her very little, she put me on hold, i told her i was in the ohio market and there were no more phones left at any best buys.....and she tells me....to trade it for a different phone that they have in stock.....i was in shock, okkkkk. She then said she wouldnt have been able to do it anyways because i must wait 30 days, when all the other reps told me 14 days....×××× this ××××....maybe ill try again one day

Don't know if you succeeded yet...

I went through a similar situation. I tried all the suggestions about giving minimal information, etc. What finally worked for me was:

1) Started the conversation that I am very frustrated and unhappy.
I added that I only signed up with cinguar
because of the MPx220 -- this is to
pre-empt the exchange for another phone discussion.

2) Just mention low earpiece volume as your problem, that's what seems to be in their database.

3) Lied and said I went to Best Buy and tried 3 other phones, all had the same problem.

4) Said that I did some research (google) and I know my problem is resolved by a f/w update available from cingular and this f/w fix is not available from Best Buy.

4) Lied and said I had .325
