ok, i'm dead tired after staying up all night so i decided to call up some sprint stores to inquire about this 5300 earpiece rumor instead of physically going down to the stores. (by the way why do so many sprint pcs stores share the same number in yahoo yellow pages?)

1st store: rep had not heard of a possible hardware upgrade but is aware of a software upgrade (however he does not know what it does and claims store has no cable for installation as of yet). he says the reason why stores got so few phones (in the 1st shipment) is that they were delayed for software upgrade (1.032 -> 1.034?) but as far as hardware goes he is not aware of an upgrade and claims 2nd shipment should not have any hardware differences.

2nd store: asked for a technician but i guess none was around so spoke with the guy that answered the phone. asked if he could confirm this earpiece rumor and he said it's what it is - a rumor... he said his store only got 5 phones total and they're all sold out so there isn't even a "2nd shipment" to speak of or compare against - so i guess it doesn't mean there's no hardware upgrade, it's just that many stores have not yet received more phones. btw he did not mention the software upgrade.

i wanted to call more stores but for some reason 4 different sprint stores here in LA share the same number so i don't want to call and get the same person and ask the same questions... but IMO it's too early to have hardware upgrades, unless sanyo is aware of this problem before release - in which case why did they make the supposedly "flawed" 1st shipment phones? our 5300 is basically a cousin of japanese sanyo phones people over there have been using for years so you would think that it is pretty refined. also since i was made aware of this issue, i've noticed that the volume depends greatly on the phone you're talking to - some conversations i had using my 5300 were too loud while some seem to be a bit soft or just right.

so anyway, i guess even if there are hardward updates we won't find out until stores actually get the "2nd shipment" - which will be after my 14-day trial... but i have the "hardward replacement program," anybody know what exactly that does?

and lastly, i think all the 5300 owners should post their hardward versions (found in "phone info") to see if there's really any difference... mine is 0101.

well i'm have to put out who started this rumor it was iceman20 at sprintusers.com i've been trying to get a hold of him to confirm his statement. but i've haven't heard from him yet my hardware is also the same as yours and software is 1.034sp my 14 day trial is over this friday hopfully i hear something about the ear piece being upgraded on the 2nd batch if not i'm going to go to cc to buy one there. this friday their suppose to get them well the shipment comes in on wednesday
