Questions about warrenty replacement (T-mo/Sk2)

I had a sidekick2 before and I'm still not clear on what happens here if you have one that resets by itself and/or freezes up.

When my previous one started acting up, I sold it for a v635, and now I might be getting cash and a sk2 for my v635, so I'd like to know what I can do when I get it.

Is it ever out of warrenty and how do I check that before I accept the trade. Also who do I call for this matter, in order to get a replacement and send back the defective one.

just call tmobile and tell them they should just charge u a out of warranty fee
