Need help with my Hiptop 1

ok heres the story lol
I purchased a Suncom branded Hiptop off of ebay for use on the Suncom network. The product description said phone was in excellent working order and all and all i had to do was pop my sim card in it to get it to start working. Well I got it here and popped my sim card in and it came up with a Net 7 error. Which after doing a lil bit of research I discovered that the error code is basically a radio firmware failure and the death of the phone. Because it wont pick up any signal. Now with that said.
The people over at Suncom are retarded by the way, I was on the phone with customer service and tech support. They gave me different answers every time I called. I never told them the phone was messed up or anything, just asked general questions and all. They asked me when I got it and i told them a few days ago and I guess they just assumed it was a new phone. Well they let me add an Insurance and Warantee combo to the phone, I gave them the IMEI number and all and they accepted it into their system.
Now my question. Do you think I will be able to call them in a few days, and either 1. Tell them my Hiptop is malfunctioning and have them send me a new one or 2. Tell them I lost my Hiptop or it was stolen and them send me a new one? and which would be the best route to go. I was also wonderin if you all think that they still even carry the Hiptop 1 or maybe they would end up sending me a Hiptop2?
Im not really sure how phone insurance and all that works, is there any way that they would be able to trace and tell the phone was used or whatever? I mean like I said they acceped the IEMI number of the phone, the girl on the phone was a lil shocked that it wasnt already on the account but i think she was new so she added it in anyways.
I emailed the seller this morning so maybe he will refund my money for the hiptop or send me a new one out.

when i called suncom customer service/tech support these are some of the answers i got. And I called back and asked the same answers that they gave me before and of course I got contradiction
The Hiptop requires a different kind of sim card that a regular phone
I need to add the Hiptop data plan before the hiptop will activate
I have no idea what a Hiptop 1 even looks like
It may take up to 24 hours for your sim card to even read the hiptop, even though the sim card was already activated in my other phone for over a year now.
and other crap answers. No one could even tell me what a NET 7 Code was. My thing is if you carry the phone shouldnt u have a technical manual on the phone to help customers go through problems. they just seem like the just "wing it"
So anyways do you all think I can get away with the whole Insurance/Warantee thing being that its on my account now, or should I just take it back off and consider this a lost cause?

1. So the Hiptop is DOA and the people at SunCom are retarded? Ok...

2. Both options 1 and 2 involved attempted fraud on SunCom and you say SunCom is retarded? Ok...

3. You've never had service with SunCom AND this phone is years old yet your labor under the delusion that SunCom is just going to "send you another phone". But oh yes..SunCom CS is retarded... Ok.... Uh...do you know what "out of warranty" means?

4. When they said "requires data plan" they were right...for the data portion of the phone. But as you say, SunCom CS is retarded.

5. You ask people if they think you can "get away with it". But yet, again, we have your statement that SunCom CS is retarded.

If you bought the device off of ebay and it doesn't work, your recourse it to go back to the seller through ebay and get a refund. Suncom owes you NOTHING out of this deal.

The device is WELL out of warranty if it's a hiptop1 and no matter WHAT the local CS reps tell you, if you send them that device for repair or claim it as lost or stolen, a *rudimentary* check of the IMEI will turn up the original owner. The IMEI is an important part of making the data services work, and Danger can produce a list of every user that's used a particular IMEI (or every IMEI that a particular user has used). I know, I've seen mine - it's enlightening.

You need to have the hiptop data service on your account for the device to work - if you don't then the device isn't going to be anything but a phone. Tis is another point to prove you're trying to defraud Suncom should they choose to make the point - if you've never had this service on your account, there's no way you ever bought a hiptop from them.

Go back to ebay and get your money back from the seller. Suncom has NO responsibility to do you any deals, and the fact that you're openly trying to perpetrate insurance fraud on them isn't going to make them any happier to do business with you (have I mentioned just how little of a sense of humor that mobile carriers have with insurance fraud? They'd be eager to throw the book at you just to make an example of you for the next guy...)

wow ok. ive had suncom for many years now. i just got the hiptop. i have set up with the ebay seller to get a replacement hiptop. so maybe i will get lucky and actually get one that works. so you may stop bashing now thanks for you grade a help
