Got a defected SKII

Okay...So I went to this guys T-Mobile store that I know, and I wanted to buy an SKII...He didn't have it so he ordered me one off of ebay...The phone came and it was defected and I was supposed to send it back...I hadn't sent it back yet and the guy called me telling me that the people had recieved the phone and are sending the money back which was weird because I never sent the phone...Now I got the money back and the defected phone...Anyone know what I can do to fix it or trade it in for a new one?

You went to a t-mobile store and some guy there for you a phone off of ebay?
Run, don't walk, away from that deal. Be lucky you have your money at all.
