ok.. im getting used sidekick.. but if something happens to my sidekick 2.. can i exchange from tmobile?

No. You're buying a used Sidekick. Why would T-Mobile exchange it for you?

if you bought it second hand/used, then there is no warranty, since no receipt was issued. the receipt is the key to your warranty, plus warranty is not transferable anyways.

I wouldn't get a used sidekick, becuase the battery is most likely not in great shape or will go defective soon, and there isn't a removable battery solution. I would spend the extra money and get a new one.

There is no basis for your assumption about the condition of the battery in a used Sidekick. Additionally, a new Sidekick also has "no removeable battery" so the user is in the same boat new or used.
