problem with upgrade.

ok to make this short i do upgrade at bestbuy return and its been one month. i didnt know the contract wasnt canceal so i dont have upgrade. called bestbuy and tells me to call cingular. before i waste more mins i want to know if i can get my upgrade back or not. thanks

What??? OK, I'll try to respond to what I *think* you said, but some more information would be good.

1. When you returned the phone to Bestbuy, why didn't you just exchange it for a different one?

2. Has it been MORE than one month, one month exactly, or less than one month? If it's been more than one month (or even one month exactly, since this isn't February), you are locked into the contract you signed at Bestbuy.

Nobody here can tell you for sure what you'll get when you call Cingular. The most I'd expect you would be offered is to get a phone at the 1 year commitment price for a new 2 year commitment. What I don't get is why you didn't exchange the phone when you returned it at Bestbuy. Did you just get your money back?

sorry i was rushing to make this thread so i could play some WoW... so yeah i went to best buy to do a upgrade for a SLVR. and i didnt think it was worth $250 so i returned and they returned my check. and it HAS been one month since i returned it. so i know i wont be able to get my upgrade back i wanted to get a new phone from them anyways. i want to get a 8125. whats going to happen?

OK. Here's my take:

1. You got ripped off by paying $250 for the SLVR at Bestbuy in the first place.

2. From your perspective, the important part of the deal is getting a new phone at a discount. From Cingular's perspective, the important part is getting you to commit to 2 more years of service, and the phone is just an incentive to get you to do that. So, it's not surprising that they didn't cancel your contract when you returned the phone.

3. However, Bestbuy should have informed you of this and given you the option to cancel the contract renewal when you returned the phone.

Here's what I would do. Call Cingular customer service, and explain to them exactly what happened, emphasizing the fact that Bestbuy never warned you your contract would remain in effect even after you returned the phone. Tell them that you want to stay with Cingular, but that Bestbuy wasn't as up front with you as they should have been. It's *possible* that they'll cancel your contract and let you renew again (as long as you renew IMMEDIATELY) to get the 2-year price on the 8125. What I think is more likely, unfortunately for you, is that they'll offer you the 8125 for the 1-year price if you extend your contract for 2 years from now. Good luck!
