First Time Dropping 8125...

My first and only time dropping my 8125 and now there's a BIG dent in the touch screen... Think it's possible that Cingular will give me a replacement? I just got the phone about 2 weeks ago or so...

I just ran my 2 week old car into a Tree and now theres a 2 Foot Hole were I went through the Windshield. Do you think the dealership will replace it?

Two terms come to mind in this scenario: INSURANCE (with appropriate coverage Terms and Conditions) Usually purchase additionally at time of purchase or usually required to be purchased soon after OR
Warranty (Terms and Conditions provided at time of purchase) and is usually included with the price of purchase.

One thing that I notice in many of these kind of Posts, is that the Buyer has just recently purchased the equipment or "I only dropped it but one time" (In this case both. Wow, it's a double!) Thus they feel that becuase they just recently purchased said item(s) that there is some special caveat that covers everything, including acts of Gods Fire Theft and Abuse, because they just "recently" bought it. I have looked at many warranties in my day, and NEVER have I seen anything akin to we cover against manufacturers defects in materials and workmanship, unless you just recently purchased it in which case you can go blow it up with an Atomic Bomb if you care to, and we will be glad to replace it at no cost, because it is new and your not "really" responsible for it yet. ( Just outta curiousity, to all of you under this special caveat, when does the Non-Responsibility Period for new purchases end and you really "Own It" begin? I would like to know) It is kind of like getting married and pushing your wife off the baconey 20 floors onto concrete during the second week of lmarriage. Can you tell the Police it really isn't murder or manslaugter, "we just got married last week." (I can see the Husband and a friend High Fiving each other on the balconey. "Man, thank god I only married her a week ago, can you imagine if it had been a month ago? I'd be in deep trouble here!)

ZOK enough dreull wit and sarcasm, let us look at reality. (What a concept)

INSURANCE would resolve this matter is you had a paid policy that covered Buyers negligence causing damage to the LCD Screen. LCD Screen specific coverage is very important because even many insurance policies do not cover LCD Screen/ Display damage due to negligence, and if so, they will also carry a large deductible.

WARRANTY; A warranty is usually provided by THE MANUFACTURER, unless you have additional arrangements with the Seller*. It usually covers failure of the device due to faulty materials or workmanship. Industry standardsa are usually 1 years, in exterme cases with higher end equipment up to 3 years. Some sellers also sell an extended warranty that covers different situations, did you aquire anything like that? If so then you may very well be entitled to a replacement.

* NOTE: Some carriers such as TMOBILE or CINGULAR, have what is known as an advance exchange program. This is were they basically offer a service to you where they will provide you a replacement phone (from stock provided by the original manufacturer), usually a refurbished or "new" phone rebuilt with refurbished parts (Not much difference if you ask me) and then they ship the phone back to the Manufacturer for warranty service. This is not to be confused with the Carrier assuming the warranty. This is nothing more then a courtesy, to keep their customer happy and using airtime, instead of waiting for the 14-21 day normal manufacturer warranty turn around time.

Not that it helps, but Amex Cards are great for this type of situation. They replace the item for the first 90 days if it lost/stolen or you break it as long as you charge the full amount to the card.

Let me add another bit of info. I must assume that you are getting an Exchange By Mail through Cingular. And part of the Exchange By Mail procedure, is that you are told that if the Phone is determined to be damaged or misused by the customer as to void the warranty,and that is definitely the case here, you will be assessed the full value of that phone, as quoted to you and that you agreed to on the phone. You also agreed to and was recorded doing so, that you understand that if the phone is determined to be misused or broken by the customer as to be not a warranty issue, the phone cannot and will not be returned to the customer and their decision and charge for the phone is final.

So, if someone at Cingular decided to replace your phone with a broken LCD for free , No Questions asked, Merry XMAS. Although I just do not see someone calling up and saying," Hello, I was abit fumble fingered and dropped my phone the other day and now my screen has a big dent in it, can you send me another one?" "Well Mr. Johnson, Cingular Wireless is sorry to hear that you are having problems with your phones screen due to your dropping it. Please allow me to rush a new one out to you with a nice new screen to you right away!" .

As a CINGULAR Customer, I think I can speak for all of the customer base when I say that it is a pleasure to help pay for a replacement phone for you. To get a chance to absorb the cost of your negligence and pay for your mistake is a Memorial Day special gift for us all!. But if you decided to be creative with some "I just got my phone, and noticed that there is something wrong with my Screen" I can only say " Get ready for "The Big Charge"

Regardless of whether anyone agrees with the OP its unacceptable to call anyone names and flame in here. If you guys disagree with a post, report it and let the mods deal with it. If you take matters into your own hands and start calling names your going to find yourself on vacation from the forums. Also, one dosent have to call names to flame, and if you want to engage in a personal attacks on someone, provoked or not, without just reporting it and letting mods deal with it earn themselves a vacation as well.

Report it or take matters into your own hands and see what happens.
