For the mobile devices it is the chipset that needs to be updated with the faster codes to allow transmission of data that fast (it was the same with EDGE at it's launch). The network often needs updated software to allow for the increased data speeds as well. Not to mention the sites need to have enough t1s to allow that much data. I wouldn't be surprised if the transport on some sites are not upgraded to allow for the full HSDPA speeds, since they all are not likely to need it.
