    On Monday during a trial before the International Trade Commission, Microsoft requested that the ITC halt the import of certain Motorola smartphones running Android that it believes infringe on seven of its patents.

    Microsoft:

    “We have a responsibility to our employees, customers, partners and shareholders to safeguard our intellectual property,” David Howard, Microsoft’s corporate vice president and deputy general counsel for litigation, said in an e-mail. “Motorola is infringing our patents and we are confident that the ITC will rule in our favor.”
    Motorola's response:

    Motorola Mobility is “vigorously defending” itself “against Microsoft’s patent attack business strategy,” Jennifer Erickson, a Motorola Mobility spokeswoman, said in an e-mail. “We have also brought legal actions of our own in the U.S. and in Europe to address Microsoft’s large scale of infringement of Motorola Mobility’s patents.”
    A ruling in the case is expected early November.

    HP has officially cancelled its Pre3 launch in the U.S. Big surprise...

    It will, however, be available soon in France and the U.K. for $75 USD unlocked. North American users can pick one up if desired, but support for North American frequencies is limited.

    HP seems to be in a hurry to dump all their webOS hardware. It appears that starting today, you may be able to pickup a 16GB TouchPad for $99 and a 32GB one for $149.

    In a memo sent to HP affiliates, the company issued the declaration to begin liquidating TouchPad inventories, with a price cut of $300 or more:

    HP will be lowering the price of the TouchPad beginning Saturday 8/20/11. This is the lowest price ever for the TouchPad so please post it as soon as it goes live.

    16GB TouchPad- $99; 32GB TouchPad - $149

    In light of HP shutting down webOS device operations, Microsoft's ever-vigilant Windows Phone 7 evangelist Brandon Watson posted the following tweet yesterday in an attempt to lure disappointed webOS developers over to Windows Phone 7:

    To Any Published WebOS Devs: We'll give you what you need to be successful on #WindowsPhone, incl.free phones, dev tools, and training, etc.

    Scott Adams, creator of the Dilbert comic strip, recently accepted a challenge by Windows Phone evangelist Brandon Watson to test a Samsung Focus with Windows Phone 7.5 Mango and that if he didn't like it better than his iPhone or Android device, $1,000 would be donated to his charity of choice. The challenge was issued in light of Mr. Adams expressing discontent with his iPhone 3GS and a HTC EVO 3D.

    After putting the device through its paces, he concluded with this:

    If you want a smartphone that is easy to use, performs well, has a good battery life, and doesn't frustrate you, the Windows phone is the best choice of the three options I tested. All you give up is some hipster credibility and access to lesser-used apps.
    Will his opinion sway anyone or it just... meh?

    HP announced today that they plan to discontinue work on webOS devices and are seeking other ways to capitalize on webOS software. From the press release:

    HP reported that it plans to announce that it will discontinue operations for webOS devices, specifically the TouchPad and webOS phones. HP will continue to explore options to optimize the value of webOS software going forward.
    Considering the lackluster market adoption of webOS devices, this move was expected. HP previously hinted that they might consider licensing webOS to other hardware vendors, and now that they plan to exit the webOS device business; it's possible webOS could appear on devices from other companies in the future.

    According to a report by AllThingsD, major electronics retailer Best Buy has only sold 25,000 units of the 270,000 HP TouchPad tablets they have in inventory; not accounting for returns. The situation is so bad that Best Buy reportedly doesn't want to pay for the remaining inventory and instead is asking HP to take them back. Ouch.

    Other major retailers are also reporting lackluster sales of the TouchPad.

    Do you own a TouchPad? Are you in the market for one? Would you rather having something else like the iPad or an Android tablet, or is a tablet just not your thing?

    A Motorola Nexus phone may be in the cards as Google has announced that they will be buying Motorola Mobility for $12.5 billion in a cash acquisition.

    The deal will allow Google to acquire Motorola's patent portfolio to protect itself against patent litigation, as well as its set-top box business which could be a boon to Google's faltering Google TV service.

    The deal is set to close by the end of 2011 or early 2012 pending regulatory and shareholder approval.

    One of AT&T's main arguments for acquiring T-Mobile was that they needed their resources to expand their LTE network from 80 percent to 97 percent of the country.

    However a letter that was briefly posted on the FCC's website by a law firm representing AT&T contains information that appears to undermine the argument according to an analysis by DSLReports.com. DSLReports speculates that AT&T simply wants to reduce competition and doesn't need T-Mobile to expand their network but rather is using the expansion argument as an incentive to get approval.

    What's your opinion? Does AT&T really need T-Mobile or are they simply buying them out to better position themselves against the competition?
