    Moving on, I've now consulted with two attorney friends of mine and although the above poster is right that you don't need a rocket scientist to interpret this most basic of contracts while in conversation with them I brought it up so they gandered a look. One laughed and said good luck Cingular and the other said he'd make the call for me.

    Come to think of it, didnt Verizon go through this exact same thing?

    I think for the sake of this topic and the laws that are coming into question, some of you might want to give the following thread a read.

    Can I "grandfather" my 2 cent incoming text? If not, no ETF for me?

    i am not only a cingular employee, besides my 3 work lines i also have a family plan that consist of 3 lines, that i pay full price for. so don't think that my opinion was just based off my employment. so cingular gets a chunk of my paycheck each month also.

    my first post came out wrong, but my issue is that if someone is just getting out of their contract for no other reason than a $.05 increase in a service that was never even used by that said customer that it is really lame. i have just learned from being on the other side of the counter with a customer that has that type of mindset nothing you ever do will satisfy that customer. so i would rather the customer just move on and not take up my time or theirs. do you cancel your cable service every time you find that the monthly rate is going up?

    Well, that depends...does the cable service in town have any real competition? And, what is the percent increase? With a similar % increase in my cable, you can bet I would turn off the TV before paying that much!
    And, yes, this may just be a convienent excuse for someone fed up with a number of smaller changes in Cingular Service....There are plenty of areas that have expirenced a decline in service since Cingular took on AT&T. Besides, most Cable Service is not on a 2 year contract!

    dish network or direct tv, but those are the only other 2 options. those are the 3 cable packages avaliable to me now, so i'll pass and just wait on iptv!

    I'm sure Cingular would have no problems with someone shorting them $.05 for services they rarely use. I mean, they wouldn't be lame and make a contractual issue out of it now - would they?

    I would rather Cingular let me move on to a carrier to who can actually provide a signal that I used to have. It's a shame Verizon doesn't have the Libra yet or I would try to get out right now as well.

    My issue is that if a company charges 50% more than contractually agreed, for a service with already obscene profit margins that places much less load on their network than the alternative (voice calls), while giving away the alternative like water (unlimited M2M), that is really lame. Oh, and did I mention that I'm still pissed about getting billed for incoming SMS? It doesn't really matter because I have a plan and I never even come close to using up my messages, but I dislike it on principle. How'd you like it if I took a job with Amazon.com and unannounced and unexpectedly dropped some goods off at your door, without asking whether you accept the items, then sent you a bill?

    Is it worth my time to use this as an excuse? No. Especially since Media Max is part of my contract, so I'm not in any way affected by this and would have little ground to stand on, but I wouldn't mind seeing Cingular get raked over the coals for this by those who are affected.

    Hey cintd here we go again. The problem getting lawyers to post, or even get interested, is there is no check in it for them, giving free legal advice is worthless, and can get them in trouble. They can post law but won't interpret it and they can be held to a higher standard than the general posters. So using the fact that no one posting is a laywer is kind of self serving don't you think?

    But in any case I do believe Cingular has indeed learned from what happened to other carriers. It worked, they got their raise, used(adj-Definition: secondhand)a get out disclaimer, grandfathered where they had to, and got the bulk of what they were after.

    Again we can debate all we want, but until true competition is reality it will only continue, and I fear reveal the rest of the ugly iceberg!

    well for everyone that would want to leave cingular...where would you go? then only place with a lower plan for me would be going to sprint and getting unlimited data with 1000 text and 200 daytime minutes for 55, which is 15 less than i spend with cingular. The drawback is cant quickly switch among phones.
