i went to ebay to look at the fraud protection right?
is there a way to really get my money back?

1) i got proove that the listing said the phone is unlocked

2) i got e-mail regarindg this fact too

3) he said he will send next day but he chickened out and told me too expensive and went until wednesday that i received the fu cking dam e phone which does not fXXking works.. coz i should received it ahead of chirsitmas time..

so does those enought to file a claim?

eBay fraud, from what I know, can't do much. Again, if you paid by credit card you may be able to contact your bank and talk to them to see if they have protection against these things. Major credit cards like Visa and Mastercard usually do. (I hear this isni't always an easy process, however.) If you paid cash, well...

Perhaps you might want to try and buy LOCALLY. GTA must have many phones available... in GVA, you can find a phone for sale all the time.

It sounds like you're after a single-mode tri-band "world" GSM phone, and if that is the case... Do you know what you're doing? You're using a dual-band dual-mode TDMA phone - the 8260 - which means that it will run on Roger's TDMA800, TDMA1900 and AMPS towers.

If you use a GSM phone, you're in a completely different world. Analogue and GSM don't work together, you cannot slide between AMPS and GSM in one call session. Generally, analogue is not used for GSM.

GSM in Canada runs on GSM1900... thats it. The other two frequencies, GSM900 and GSM1800 are used only outside of North America, so unless you plan to travel internationally, those other two bands (900/1800) are useless to you (as they can only be used outside North America). Remember these "world" phones don't include analogue either... tri-band GSM phones are GSM900/1800/1900.

I suggest you stick with a single-band (GSM1900) phone as they're cheaper or get a dual-mode single or dual-band phone with Rogers TDMA or Telus CDMA.

If all else fails, look locally on USENET, post in the BUY/SELL forum on here or look in your newspaper's Classified section. There are tons out there. Many are for decent prices and a few for really cheap.

and besides iwill switch over to fido..
fido is cheep and great to use with.......

If you're switching to Fido/GSM, you only need a simple, GSM1900 phone (unless you have major plans to travel abroad). Have you checked out Fido? They still have their promitions running. You can get Fido phones in relatively good conidition locally (in GVA) for as little as $20-$50 (or even free, at the moment). I'm sure Toronto is the same.

I don't know if I read it right, that they're this that this is their this that they're there...?! If they have claims then go for it. I've had problems with bidders before and eBay basically told me - tough.

If the phone is locked to the Cingular network, you'll need a unique 6-10 digit code to "unlock" it. It's not that simple as punching in the operator code. I'm not sure about Siemens, but if you fail the this code 3 times... the phone may be locked forever and/or you'll have one expensive paperweight.

I've seen this "remote unlocking" before and have not heard of any success stories yet. On USENET, I've found many to be scammed, losing money, giving away IMEI info, etc. Though anything is possible, I really wonder if I could trust this guy...

spear... I don't have the time to make or get a cable... I do everythign via infrared right now. If it does work, exactly how and where did you get the algorithm from? Let me guess, you work for Siemens and you're the one that developed it... suuure.

aah_tree... a few things:
- you have a T18z? That works on Fido... you could just use that. You didn't need the S40.
- Please remember you can edit a message instead of re-posting. Not everybody is on broadband and such bandwidth is precious.
- "spear" charges USD$15 and not for free. He wanted to prove otherwise because I don't believe him (and still don't).
- To get a "guarantee" from somebody like spear (or anybody you don't know on such an grey topic) is like getting a guarantee from that eBay guy or from a store called "Stolen Carz R Us" saying that all their cars are perfectly legal...

If I were you, I'd just try and resell it instead of taking even more risks. Apparently it seems you have bad luck for the last three chances. Maybe it'll be fourth time lucky, but maybe it'll go sour as well and not only do you have a locked phone but worse - nothing more than a fancy paperweight. With so much hassle already, I'd just play it safe right now.

well i am going to try the last thing, i will call cingular and hoping they will give me unlock codes, i knwo STYLES works in cingular and i wish he can somehow do me a favor, and i will do him a favor a$ well... well if that does not work, i will resell it but b4 i do that i will go to ebay and ban that fuC ker's *** account.. and made him pay for the delivery + the time and effort i ddi trying to unlock the d@me phone

i wish someone here that read this is a cingular custome so they can get me the code, coz they can say that they were using the siemens thati have b4... nd still using it, coz in gsm, they do nto care which phone u use, as long as u are their customer, and i fink therei s no way that they know about the phones u used..

yeha i got a t18z but it is fuXked up.
that is why i need a new phoen..
i was on rogers on 8260 and contract is over and my phone is kind of screwd, drop calles, can not received, screen turned off.. etc.. i was getting it repair but i changed the lights all over + casing + flashing all the way.. so nothing i can do..

so s40 is my last hope

Earlier, you posted one message twice with the second one adding a few more lines.

Somebody is giving away their functioning T18z here for free... probably gone by now.

You may want to consider getting a rugged phone from Motorola or something. All the phones I've had have been through some rough situations (even falling 12 feet) but not so bad as to damage the phone.

Providers can track down and/or blacklist a phone if they choose. Every phone's serial number (IMEI) is registered on the network before you get any signal.
