If you bought the phone from Rogers, it is in their database. Whenever you connect to the internet, you IMEI is sent to the Rogers Tower and then fed into the system. Based on your IMEI, the billing system will charge you accordingly
Example: You have the 5$ unlim on-device data plan and you own a W580i and a HTC Touch.
When you put your SIM into the w580i, the system recognizes it and doesn't charge you anything extra to access the net. IF you then take the SIM out of the W580i and put it into the HTC Touch, as soon as you try and access the net from that device, it'll send that IMEI for that 'session' and you would be subject to pay-per-use charges (either 5cents/KB or 3cents/KB - not yet released - probably 5cents though)
If you are using a NON-ROGERS phone, The billing system will not know what phone you are using so it assumes you are using a data device and would also be subject to pay-per-use data charges on the $5 Unlim on-device plan. The WM packages will work for non-rogers phones though

The only way to "get around" this is by changing IMEI (ignoring the fact that it's illegal in certain countries - it's a chore to hot write an IMEI, but give me a computer, a mini USB connector and I'll do it) or by taking advantage of the short delay in when the system checks for your authenticated IMEI and reports back.
Don't expect any "Opera Mini exploits" to work with this, gentlemen.

Yup you are right, but in this case, Rogers doesn't care.. If you didnt buy the phone from Rogers, they don't want you to have unlim data for $5
This 'database' is generated by Rogers for phones that they have sold to customers.
Seems pretty straightforward and frankly I am surprised it has taken them this long to finally control their own network and plans. I think the Bell $7 Touch deal (and Telus $15 with unadvertised free browsing) has shaken a few feathers at Rogers, so now they will also be able to offer device-specific deals without worrying about people switching sims or using laptops.
All in all I think it's a very good thing for rates, although not good for unlocked phone users.
I still give it two thumbs up since I figured it was inevitable anyways, and at least we can get cheaper rates. Here's hoping it gets released on Fido at the same time!

If this is the case then I think Rogers should be clear and include the "NON-ROGERS" phone in the exception list otherwise CSRs will get a lot of complain and customers try to get the credit back because for example, N95 is a smartphone not a Windows Mobile, PDAs or Blackberry phones...
and what about Rogers phone for example, SE K790a, which has full HTML capability... and if we unlock it, will the Rogers unlocked phone still allow for $5 unlimited On-Device Mobile Browsing...

well, that is fine it they can restrict by IMEI... but then for their customer base, they should (1). come out with a decent windows/pda/bb plan (not the crap that they have now, they suck real bad, and super bad compared to the new $5plan), and (2). allow people to add two kinds of data on their account so that they can sim swap if they choose (and each data bucket is used accordingly)..
If thats too much for them to handle, then take out the stupid restriction and just hard cap it already. They are going to get so many complaints from users who dont know the details. (u know the reps wont explain it all in detail, so..)

Whoops! I omitted the word "not"! Sorry! You'll be fine as long as it was a phone from Rogers and it has the same IMEI. But then again, maybe they'll make you only use the same phone you were using when you activated the internet plan. Who knows...

They won't kick you off but you can't use the Internet properly ... Remember long time ago my Rogers K790a unlocked used to have the internet properly with the currently $5 MB plan ... but after Rogers had the "Mobile Internet Service Upgrade" on September 8th... It stops working as it was... So I had to remove that $5 Mobile Internet not working anymore for my K790a unlocked phone... Don't know if that issue is fixed now...
So it would make sense if they would let you register an IMEI with them for these plans. This way they could sell you a plan and not worry about having to subsidise a phone?
so this unlimited on device stuff what is it? cant use it with a blackberry or what? what if under my account its listed im using a w810i and technically i got a pearl 8100? what happens?
also what happens to people that are on the 10mb vision plan? like me
