Most likely the Branded/Locked phone itself. You can Debrand/Unlock the phone yourself or get someone else to.

What prevents my W810i from using any MP3 as a ringtone?? Even ones I get off the net and ones I've made.... What kind of lock is preventing this grrrr.

Debrand the phone and you should be able to use any MP3 as a ringtone. I debranded my SE w300i and my SE w580i. Both had the MP3 ringtone restriction and now both are able to use regular MP3s as ringtones. My Nokia N95-4 had a similar issue and debranding it also fixed this issue for me.
Most carriers will restrict the use of MP3 as ringtones since they want you to purchase ringtones from them.
