The concern is whether the phone is unlocked not which OS it has. To know if the phone can even be unlocked, you need to look at the baseband:
go to: Settings>General>About>Modem Firmware
5.11.07 (firmware 3.1.2)=Can be unlocked and jailbroken
5.12.01 (firmware 3.1.3)=Can be jailbroken but unlock has not yet been released

They just released a 3.1.3 unlock but per my understanding, it only works on the 3G, not the 3GS. There's a guy a tmonews forums who's good at tracking all of these unlock/jailbreak solutions. Here's his latest thread from today about the new release:

does anyone know if tzones works seamlessly with the new Nokia E73? as with other symbian devices, it *shouldn't* be forced onto a smartphone data plan, but i just thought i'd ask if anyone here has experience. also, a little off-topic, but if anyone IS using the E73, does UMA work? TIA

This person got around it by using internet2. Up until that time, I did not know that internet2 had become available on T-Zones. But I tried it on my T-zones plan and was able to get both internet2 AND internet3 to work.
Has anyone else on the T-zones plans had any connectivity issues in the past few days?
Is there any advantage going from wap to internet2 or internet3 with t-zones?
The short time I was on epc, with a new HD2 that I had not changed any of the settings yet, my-tmobile flagged my phone as an HD2. I switched back to wap and the phone ID to shadow and it it has stayed that way ever since. My wife who is on web2go using internet2 with a iphone, gets tagged with an unknown phone even after I switched the ID to a Nokia. It looks like wap is not monitored, but internet2 and epc are? Or is internet2 not monitored with t-zones, but is with web2go?
T-Mobile knows what phone you're using. Customer service can access this info. It is completely different from my-tmobile. My-tmobile is programmed by a bunch of incompetents. Who knows when and where they pull their phone information from. It's been getting less accurate these past few months.
I still have my grandfathered TZones for $4.99 from 2005.
Can I get any of the following phones in UNLOCKED condition...
Samsung SGH T749, N900, or Nokia Nuron
... and still get 3G speeds here in Chicago?

If the T749 or Nuron is branded T-Mobile, you wouldn't need them to be unlocked to use them with T-Zones. If they haven't been unlocked, then they will still work.
I think the N900 was only sold as an unlocked version so it would work fine as well. The N900 should give you the fastest data speeds of the three since it's maximum speed is 10.2 Mbps down.
I have the SGH T749 Highlight Ice w/ $4.99 plan I got my phone upgrade @ costco so phone is not broken its a tmobile / factory phone and I am very happy with my internet on da phone
