Could you return the one that's being brought to you in the mail to the Nokia store in NYC and avoid the restocking charges?

I just called Nokia customer care to cancel my N97 pre-order, since I got one yesterday at the NYC store
However, I was told that I cannot cancel my pre-order as the N97's have "already begun to ship", even though my order status still shows up as blank.
So apparently, my CC will be charged for the phone (again), and when I get it in the mail, I have to call Nokia again and receive a return authorization ##, after which I can send it back.
However, I will be charged a 15% restock fee.
This is BS. I tried calling yesterday, but I couldn't get through since they were busy all day!!![]()
So, now what? Call again and *****? Deal?

Don't you need to call Brightpoint and now Nokia Customer Care? Brightpoint is the company that's handling the N97 delivery and you'll likely have better luck if it hasn't been packaged to be shipped yet.
Just refuse the shipment. It may take a couple weeks to get your credit on your credit card though.

Restocking fees SHOULD only apply to open items. As others have said, call Brightpoint and if you don't get any resolution with them, refuse the delivery when it arrives.
Nokia should be bending over backwards for you after buying it at FULL RETAIL from their flagship store with tax and other added expenses on top of it.

Restocking fees are supposed to cover the difference of turning an opened item into a salable item, not the cost to have an employee walk to the back room and put the box back on the shelf.![]()
If that is their policy in the fine print, it's absolutely ridiculous. People preordered online from a site that said "Be the first to own the Nokia N97" and then sold it in their flagship stores first. Their entire sales campaign for this device has been nothing but BS just like the 5800XM and you bet your *** I'd pitch a fit to a supervisor if I just dropped ~$800 at the flagship store to truly "own in first" and they tried to charge another $105 for a restocking fee on an unopened, canceled preorder.
just like i said... you got to pay to play......... You dont agree with the 15% restocking fee then don't order the phone..... end of story....
