See, all they have to do is offer you an upgrade, and then they've met the clause of allowing you to carry on with the terms 'unchanged' because they're letting you upgrade at the timeframe that was originally there - except you're renewing your contract at the same time, and therefore agreeing to the new 30 month policy.
Besides that, there's nothing actually written in the terms about when and how you can upgrade. Plan changes, local calling area changes, all of that - those are different, that's what you agreed to when you initiated service or renewed. Upgrade time really is at the discretion of the provider.
