It is a good move by T-Mobile, people dont care about the tech, just the result. And T-Mobile's HSPA+ network is seriously fast and well built. 75+ cities now too.
Sprint, AT&T (the targets of T-Mobile's new ad campaign) and VZW have no legit grounds to sue for anything.

I don't really think that there is a legal remedy for Sprint & Clearwire on this matter. They could begin by making sure that their backhaul is robust and then upgrading their existing and future networks to Enhanced 802.16e when it's made available.
In theory at least, Sprint could try to get really dirty and upgrade their CDMA network to EVDO Multicarrier and start claiming the largest 4G network. The Multicarrier upgrade is only software: http://www.cdg.org/technology/evdorevb.asp

I would imagine Verizon is the most pissed about this....T-MO stole their favorite line America's Largest....You know Verizon was just waiting to use that tag with their 4G...

Well you know VZW. They're just biding their time for the moment...When they officially launch their LTE network, you can be sure that they'll have some scathing marketing lined up for T-mobile and their "4G" network, and probably Sprint's as well.

Well, not much Sprint can do about it, unless they can get WiMAX to cover more area than T-mobile. Sprint's Matt Carter (President of 4G) did have this to say:
Halloween is over--it's time for T-Mobile to stop dressing up like their favorite super hero--Sprint 4G.
AT&T, on the other hand, is pissed because they have their own HSPA+ network, and claims to cover a larger area than T-mobile.
T-Mobile's claims about 4G are based on the same HSPA+ technology we have deployed to 180 million people today, more than T-Mobile’s reported 140 million, and we’ll have it rolled out to 250 million people by the end of this month, substantially more than the 200 million T-Mobile says it will have by year-end.

I was just reading about this last night. According to what I was reading, by industry standards, no US provider currently has actual 4G. They referred to Sprint's as 3.9G and T-Mobiles as 3.75G. LOL

Hmm. Sounds like a gauntlet is being thrown down at the feet of Sprint, Comcast and the other Clearwire investors. Something must and will eventually happen to resolve this rather volatile situation and the sooner, the better.and the discontinuation of development activities for sites not required for its current build plan. The Company currently has thousands of sites in various stages of planning and construction beyond its current build plan, and it intends to suspend zoning and permitting in a portion of those sites until such time as additional funding becomes available.

I think T-Mobile has bumped their head. How can they rebrand 3G Plus as 4G? They are out of control and are tricking customers. They also said today that they can't reach a 3G roaming deal with ATT. ATT doesn't have an AWS 3G network so what in the world is T-Mobile talking about.

Except EVDO Multicarrier only gives speeds up to 9.3mbps. It takes Rev B to go higher, and even then Rev B maxes out at 14.4. Those are still HSDPA speeds, not HSPA+.
Absolutely incorrect. AT&T has had 7.2 since the start of the year, and apparently has rolled out HSPA+ to 180 million people as of today. Further, their facebook wall posts said it will be 250 million by end of this month.

Yes, I'm aware of that, however, it is really immaterial at this point. There really isn't a set speed that one can say is 3G or 4G. Nobody seems to be paying attention to what the ITU says is 4G anyway, so another incremental update to EVDO, why not call it "4G" and say that they have America's largest 4G network? Seems par for the course these days. What is t-mobile going to do, sue? The same argument that has probably kept Sprint and VZW from suing them already applies. 'You sue us for our false 4G marketing, we'll point out that your network(s) technically aren't 4G either and sue you in return'. Lose-lose proposition for all involved...
