I'll try to keep this short as possible. In December I sent my Nexus One in for repair (2nd time the power button broke). After about 3 weeks and no updates or anything, I called in to see what was going on. I was told that they don't know why nothing had been done with my phone but they were going to escalate things. In the next few days the repair was done and the phone was sent back. Then the nightmare began. To my surprise one day, my tracking number said my package was delivered. The package was nowhere to be seen. My tracking info shows that it was delivered to a front desk/receptionist and that someone failed miserably in trying to write my signature.
So I called HTC and explained my situation to them. They set up an investigation and they told me they'll have more info for me in a week. So I call back in a week and am told that nothing has been done yet but they will escalate my case. They tell me to call back in a week. I call back again next week and of course, nothing still had been done. After about a month and 3 escalations, they finally told me they looked at my case and they won't file a shipping claim. At this point I had enough and asked to speak to a supervisor and explained things to her. She said my things didn't look quite right and they would try and do a trace for my package as well as try to file another claim. Another two weeks pass by and yet again I'm told they refuse to file a claim. Not only that, but they refuse to let me file a claim myself.
It's been two months now and despite the fact that FedEx clearly delivered the package to the wrong place, HTC still refuse to do anything. It's gotten to the point where I'm seriously considering taking them to small claims court and have filed a complaint with the Better Business Bureau.
I highly recommend anyone looking at an HTC phone to look elsewhere.
Sorry, but it seems you have more of a fedex/UPS issue than a phone issue.

that really sucks. Unlike what above poster said, it's not a Fedex/UPS issue. Sure they made the mistake (it happens frequently enough that is why insurance exists). HTC is the only one with the authority to make the claim with the shipping company, and the refusal to do so would make me think that maybe there was no insurance on the package.
Definitely a courier issue, and HTC will have to go through some steps to get the claim processed.
You should contact FedEx/UPS/whomever that delivered the package yourself and start asking questions - don't wait for HTC.
Stop and think about the situation first - this is one of the most common scams used to blag new phones from vendors so they will treat your claim with skepticism until they have done their due diligence. If you do call HTC again, get names, phone numbers and email addresses if possible so you can track who you've talked to and where they are.

It's an HTC corporate issue, they are not helping him resolve his case, and preventing him from contacting fedex to resolve it himself. That is a customer service nightmare.
Although it's not clear to me what is going on here...
Was it delivered to the right address, but somebody pretended to be you? That is theft. Call the police. It's not an HTC issue. Someone stole your phone. HTC cannot really be responsible for thieves who intercept packages delivered to your correct address.
Was it delivered to a wrong address? That is an HTC shipping mistake and they should take responsibility for it.
So it kind of depends on that little detail in my mind.
