Why can't all states adopt the 30-day trial period? I would love for NY to do this.

AT&T can't cancel me based on tethering, using too much unlimited data, ect...; tethering isn't disallowed by 2004 terms.
For this to work for us longtime out of contract users, AT&T will have to be forced to grandfather plans that are out of contract, as every TMobile user still enjoying 2004 T&Cs is, by definition, not in a contract, as a contract would move one to newer T&Cs. Furthermore both AT&T and the supervising regulators will need to understand the finer details of the old T-Mobile plans. Otherwise AT&T might just slop through all this and put us on their "unlimited" data plan that will be throttled around 4gb and then kick us off that when we tether. Why heck, even some of the TMobile phones from the Total Internet days have tethering built in the stock firmware (Dash 3g for example).

I'll fight whatever AT&T tries to push on me. I'm already fighting Verizon for my Centennial ToS. Verizon has severely broken the rules; they will pay for there underhanded migration tactics. There's a good chance I'll get my Centennial terms back. I might have a legal case with this Verizon migration botch (Centennial had no arbitration requirement).

I have the 2004 T&C, but they are trying to force me to pay $15 more a month to tether, which I rarely do by the way. I have spoken to customer service and was told that they can change anything at anytime since I am no longer under a contract, and I can choose to accept the changes and remain a customer or take my business elsewhere. I have the grandfathered "total internet", and originally added it in order to tether my laptop at T-Mobile's recommendation!
I am using the work arounds, and I can still tether, but it is annoying to me that I even have to.
I was curious if anyone has successfully gotten them to remove the up-sell hassle and allow you to use the services they marketed to you in the first place? If so, what specifically did you say to customer service?
Thanks in advance for any assistance.
