    For Quebec contract after June 30, 2010, you can give them the specific date of notice you want to cancel, not the 30 days notice. So porting date = date of notice = you don't have to give them any notice for porting.

    Term; Suspension; Termination

    33. The term of the Service Agreement, and any applicable Commitment Period, starts on the Activation Date and shall continue indefinitely until terminated in accordance with the provisions of the Service Agreement or applicable law.


    34. Not applicable to Residents of Québec: Unless otherwise permitted by applicable law:

    You may terminate any or all of your Services upon no less than 30 days advance notice by contacting Rogers at the appropriate points of contact specified in these Terms and

    Rogers may terminate any or all of your Services or accounts upon no less than 30 days’ advance notice to you at your billing address.

    Applicable charges continue to apply until the end of the notice period or until the Services are no longer accessible by you, whichever is later. The transfer of your telephone number to another telecommunications service provider constitutes a termination of the applicable Service(s), and an ECF may apply as set out in Section 9.


    35. Applicable only to Residents of Québec:

If you have subscribed to a plan or Service for a Commitment Period, then we may terminate your Services only if you are in default of your obligations hereunder, pursuant to Sections 1604, 2126 and 2129 of the Civil Code of Québec.

    However as written, the ToS do specify the cx shall pay for 30 days of dead-air unless notice has been given.

    IMO, if it weren't for CCTS's rigid stand against this, the common-sense interpretation wouldn't be a shoe in since Courts are generally averse to involving themselves into the details of contracts freely entered-into (yet do subject contracts of adhesion to greater scrutiny).

    TTBOMK there has been no attempted nor succeeded defeat of this scummy clause of Rog's (or any other carrier), in a Court, so IMO it's still an open question.

    However that the CCTS has taken a clear position on this does bring certainty, fairness and common sense to the situation.

    Just want to share my experience on porting out from Rogers. My bro just finished his 3yr commitment and went automatically on a month to month term. He did not give notice to Rogers and just ported to Koodo. It has been 2 months now and the only bill we got was from his remaining days of usage before porting. No 30days charge.
