I recently had a problem with my data being shutdown after upgrading to the $60 unlimited plan. I was previoulsy on their $50 plan with 250MB of data. On 9/21, I upgrade my account to the $60 unlimited plan, and on 9/21 and 9/22 I listen to Pandora radio for a total of 2 hours (on my commute home). The following day, my data no longer works. I try to reach H2O customer support via website, email and by phone; I finally get thru over the phone (after 3 calls and 40+ minutes on hold each time), but no one can help. Then just today, I receive the email response below. H2O, I hope you are reading this, because you just lost a customer.

Thank you for contacting us and we apologize for any delays in responding.
It appears the account may be low on data. Although we offer unlimited data for the new H2O $60 Month Plan, unlimited does not mean unlimited without reasonable use. Please allow for the next billing cycle, to continue the web browsing.

So what is unlimited data then?
Streaming anything is going to raise the eyebrows it seems. There already those trying to root their phone so they can tether which should get them shut off real quick.
This plan will be perfect for those that want to surf, email, facebook, etc. Even navigation seems risky.
I kept my ATRIX to see how this played out but I think I am better off staying with Sprint postpaid.
For an extra 20 a month, it's worth it.
I see a class action lawsuit on the horizon for H2O
I doubt it, Straight Talk and Simple Mobile have been doing this for quite a while with data and Page Plus did it with minutes.
Just because nobody reads the TOS does not mean it doesn't apply.
I wish the companies that have hidden caps would just be up front, put a cap on it and let the subscriber know.
At least Virgin and T-Mobile are up front about what you get.

LIEING TO AMERICANS and then ripping them off. Why do we stand for this??? Raise hell on their facebook page... they PRAISED unlimited data for weeks and now look at this thanks for the email. forwarding it to my legal reps who love class actions

I'm not defending them (I think they suck like the rest of them for doing this) but your agreement to use their service and the conditions that apply are pretty clear.
I see a class brewing unless its specifically states a cap in the plans user agreement.

UNLIMITED Data Services. UNLIMITED DOES NOT MEAN UNREASONABLE USE. If your plan includes data services, such services are provided solely for purposes of web browsing, messaging, multimedia streaming - Pandora = Multimedia Streaming........ Oxymoron anyone?
So I guess unlimited is a complete and total pile of bull*****. Attorneys are gonna eat this up and I would suggest making a screenshot of their site before they have a chance modify the TOS after seeing this.
Theres a binding arbitration clause in their TOS as well...

That may be true. but when they start these type of things their TOS is only going to hurt them more. The FTC goes after companies all the time for this kind of thing and their that clause doesn't mean a thing if they are violating state / federal consumer protection laws. People you need to stop getting bent over by deceptive marketing and do something about this.
Everybody's a Philadelphia lawyer it seems. This issue had been beat to death in the Simple Mobile, Straight Talk, and Page Plus forum but yet it doesn't seem like anyone has been victorious in the battle.
You have two options really.
1. File a formal complaint with the FTC and let us know how you make out.
2. Vote with your wallet and find another carrier that suits your needs.
