Why don't you just file in small claims court? That kind of battery failure almost certainly caused by manufacturer defect.
Instead of waiting for a class-action suit where some law firm gets a wheelbarrow full of money and you get a $5 iTunes gift card, convince a judge to make Apple buy you a new phone.
I'm pretty sure that as soon as Apple was notified of the suit, they'd take care of the replacement before it got to the judge. You probably wouldn't be able to tell anyone about it, though...

Small claims court doesn't sound like a bad idea...Class-action can help everyone...I'm doing research* now on the whole class-action process and I'm looking for lawyers/firm with manufacturing/design defect or product liability experience...CingularRox made an excellent point, battery expanding/exploding is a common issue but the point as already pionted out by Veriztd here is that the design of the iPhone doesn't lend itself for an easy battery swap...in some/many cases the 3GS is rendered useless.
With Apple's sealed phone design, the expanding battery ruins the phone, unlike all the others where a battery cover comes off.
But, what about all the others that don't feature removable batteries?
An exploding battery can still do damage regardless. Let's not diminish pain and suffering caused by an exploding battery, because the battery could technically be removed. If a person feels their battery warrants concern, what difference does it make if it is removable? Take it back to the manufacturer for attention!
What DIFFERANCE does it make if it is REMOVABLE?? maybe not a major problem to change if it does expand? I do not know about you but my time is limited , to put time aside to travel to apple with a good working Iphone and ask the dealer to take it apart and see what my battery looks like?

Ah, but Apple isn't the only smartphone with a non-removable battery.
Ah, maybe other other cell phone manufacturers are FOLLOWING apples bad design, I guess that makes it good, the cell phone that concerns me is the apple iphone, the one I had owned,
Googled iphone expansion,
found one that happened aboard a commercial airline, cracks me up, picturing the poor owner trying to explain to the stewardess that this is completely normal,and all cell phones do it,

I now use a Blackberry a great phone, now I know why they are so popular, takes a few seconds to change battery's IF you have to. and has a ton of great features, of course if the iphone had a removable battery I would prefer it, No future need to write on any Blackberry forum about battery expansion , if it happened which I doubt, just pop in a fresh battery , takes a few seconds,
I still do not see any reason why the iphone could not of been designed with a slid off back secured by a couple of small screws, tell me a good engineer could not of accomplished that and had it look the same,
And don't tell me it would not of been as water resistant, take your iphone with you when you take a hot steaming shower and let me know what happens to IT just from the humidity, or sprinkle a few drops of water on it , thats why it has moisture indicators inside,

The CPSC allows anyone to submit descriptions of risks. There doesn't have to be personal evidence. With that, it looks like anyone could file a complaint against any cell phone battery and get published.

I am not denying that batteries can explode. I am also not interested in slanted demagogic stories from Cristian Science Monitor. The first sentence says enough for me: "We all know the iPhone has had its fair share of battery issues. And even some death grip problems." Whoop way to associate battery issues with death!

i have a htc hero, the batrery in that is starting to swell. the big difference in it and my iphone, is i can go on ebay, buy a new battery, and pop the back off and put a new one in. the one of two major flaws with iphones. but thats just a way for apple to sell more handsets. all batteries will swell, apple just figured that they could capitalize and get their following to buy more phones this way.

What happens in the meantime? Hope and pray the battery doesn't explode? What if it does? What if the delivery is slow? What if the seller is a scam? Batteries still can explode, regardless. There are no guarantees. If your battery is expanding, I would stop using the device and take it in for service, period.

i have had no problems with where i buy my batteries. and im not talking about those devices, im talking about what I own, and the flaws. i have a htx that had a swollen battery, i bought a new one popped it in and fixed. no sending it in for service. why would i send it in to swap a battery in 15 seconds?
same with my samsung s2x..if i drain my battery, pop in a spare, 10 seconds and im done, no bulky battery cases, or having to plug in my phone.
