You have a written understanding which is called the AT&T Wireless Customer Agreement. That's what you have agreed that AT&T provide you. I failed to see anything about "best effort speeds" mentioned in the agreement.
You would think a good company would at least have a set throttle point across the board. Not some inconsistent BS that nobody can decipher, if someone is getting throttled at 10GB then everyone should. Not just random throttle points across the board, and once the FCC and news over hype this issue, this is for sure going to kill the merger possibilities.

No. I got that text and also an email saying basically this:

"this is the first time you're in the 5%, we won't slow you down this month. If it happens again we reserve the right to throttle you" (odd because I use between 4-5 gigs every month, including last month)
"If we throttle you we will restore your speeds on your next billing cycle"
    "use wifi"
"next time we will text you if you 'approach' the top 5% and then when you hit the top 5%"
"switch to a tiered plan if you don't want to be throttled"

Also, AT&T wifi is a joke, might as well be using EDGE. Fortunately I have Optimum WiFi which is genuinely fast 90% of the time. Regardless, the heaviest data usage points are when I'm in my car or when I'm in the office. No wifi there anyway.

Not jailbroken and no tethering... just mostly video streaming. I'm in southern California.

AT&T needs to release a statement and come out with a specific point at which they throttle, its being vague. Glad they didn't throttle you, they really shouldn't do it until they come out with a set point.

This is my market too, and AT&T's network is overworked here. Still <3GB is unfair

I filed an FCC complaint about it because they need to come out with a set point like Verizon does for their 3G handsets (They don't throttle 4G LTE handsets)

This is bad, after 2GB? So they are pretty much forcing people away who have unlimited.

It shouldn't matter if you use 2GB in 10 days or 30 days, some people may travel early in their bill cycle and need more data.

With speeds like this, I would say Sprint is a better option. At least in some markets you can hit 2mbps+ on 3G.
    Home ISP, RR-Ultimate WiFi, $90/mo | Verizon 4G, $30/mo Unlimited

    School, $5,000/semester | Work

That's becoming increasingly-rare in DFW. I mean, this is the fastest I could get on WiMax at the Sprint store yesterday in a growing suburb:

    But I digress..

Bad is an understatement. Its like going back to a dial-up internet connection after getting used to cable/dsl. With speeds like that, its like utterly impossible to over 3GB... Come on, AT&T, I know you can do a proper traffic shaping without resorting to a ridiculous hard ceiling limit. Today my billing period begins again and my speed has returned to normal. THANK GOD!!

What do people want, a hard ceiling for throttling or a flexible ceiling depending upon demand in a given area?

For informational purposes, it seems like 3.1GB is not past the 5% mark in DFW over 3G.

Anyone else in other markets have "high" usages that haven't been throttled on 3G or 4G? We should start a list.

I was sent a text Message on Nov 1 @ noon. The Message said I was approaching the top 5% for the MONTH. Really? On the 1st?
It politely said to avoid reduced data speeds use Wifi. I only remember thinking how cheap AT&T was being, and I didn't take it as a warning at all. On Nov 14th I got another text saying that I was approaching the top 5% and was about to among that percentile. How ever this text was worded it did sound more like a warning. I received it around 7 in the morning, before I awake. 17 minutes later, while still asleep, another saying that my speed had been reduced..... Well my point is somehow on the 1st of the month, 4 hours into my day I had used so much data that I received the warning. Then on the 14th while asleep I approach the threshold and 17 minutes later exceeded. Just sharing my experience with this unexpected throttling, and complete disappointment with AT&T. FYI
I when I was throttled I was at 12454.4 MB, and I'm sure netflix put me there. My 4 year old son watches cartoons constantly, and yes I took no consideration for the amount of data that was being consumed. Honestly even if I had been aware of wifi not being contected I probably still wouldn't have thought twice about the use if unlimited data. I guess my lesson here is to leave wifi enabled.

Even though I'm grandfathered into unlimited data I use wifi as much as I can especially in my home I'm 100% wifi.

if u want to throw your $$ away then yes, do it and let them win & profit even more on your behalf …
    iPhone 4S on AT$T: Unlimited Talk, Text & Web w/NO throttling….
iPhone 4 on Boost Mobile: Talk, text, MMS & 3G Data .. since 6.11.12

If you can't see that todays society has gone to sh*t, then you ARE the problem or PART of the problem…
