    Upgrade and cancel in same billing cycle?

    I'm going to upgrade a few lines on my account but I want to cancel service ASAP. Can I cancel in the same billing cycle or do I have to wait a month?

    I am dealing with another issue about how and what paramiters TMO uses to blacklist phones. By accident I think I have your answer.

    When you are eligible for upgrades you have earned right to buy or get upgrade phone for low cost or even free. When you receive that phone its yours. As long as you are not entering into payment plan for the upgraded phone then you are free to do what you want with it. I was told lots get there upgrades and sell the upgrade phone or the phone they upgraded. This is of no concernt to TMO and your phones will not be blacklisted.

    However I was told some retail outlets like Radio Shack require your credit card to upgrade and clearly state that if you do not meet terms of contract extension that they can charge the FULL retail value of that upgrade to your CC. If you upgrade from TMO directly or Best buy they do not do this. Also remember if you upgrade you are signing a new 2 year contract. So when you say your going to upgrade a couple of your phones and cancel. Well you will be subject to early term charges for ALL phones on your account. Now if your plan is to just run from TMO and sell all your phones. You will be able to do this. Or switch to prepay. However they will sue you and up to and including wage garnishment may happen. Hope that is not what your trying to do. Just letting you know your options.

    If your a person just wanting to upgrade to unload your new phones and keep your old or visa versa. Thats you right.

    Upgrades are yours from day 1 as you earned them at the price the retail establisment or TMO has sold them at to you. They may however if retail store charge the CC you used if any to establish ID if done online to upgrade. In person they do not ask for CC.

    iceshark, thanks for the input. yes i have seen the secondary agreements that retailers use like radio shack, amazon, wirefly, etc.

    comparing their etf document to att's or verizon's, the other two charge an additional fee if you have a smartphone but don't state you need to return anything. it seems that it is within the rights of the contract to cancel at any time since the device is yours and a receipt is provided, the only requirement being the $200 per line if more than 6 months remain.

    Yep you have it correct exactly with TMO at least. ( I dont know about the others). The phone is yours as you bought it. Even it it was free. The only thing the contract holds you too is the early term fees. However if it was done in a fraudulent way such as a new account not paid even 1 month. All the phones are subject to perm TMO blacklist of IMEI. However on normal account like yours. The phones are not blacklisted even for upgrade and then cancel if your account is established as it has been to be able to upgrade. You have it from what I have been told and believe me I have gone round and round with TMO up to corp level.

    Oh and you bring up something there LP guy said. Its very common for peeps to upgrade so to speak 2 Galaxy s2s. Then cancel there exsisting account. They have to pay 400.00 to get out of contract. however they now if they got the Galaxy on a 99.00 upgrade are into it for 600.00 but still make out. Sometimes even much less. So I guess its a game people play. TMO does not seem to care. Long as they get paid!

    Yes, Please READ what your posting. This is the NORMAL policy on returning bought phones when YOU WANT TO CANCEL YOUR CONTRACT! WITHOUT EARLY TERM FEES>

    That is NOT what the OP is talking about. This is in place so the consumer has an opt out of contract. What they are saying is that for cancel of contract WITHOUT Further action up to 14 days from Activation you return phone. Then you are not liable for anything.

    After 14 days the phone is not to be returned and in fact will not be accepted by TMO or any third party for return. Its your toy to keep and use or sell and your up the creek with a balance of $200.00 per line cancelled with more the 6 monthn left in its contract. Some states only let them early term based on per phone contract. Some and most early term for each phone regardless of how long as each upgrade or add a line reknews complete contract.

    What they are saying is if you cancel and dont return the phone within 14 days they may blacklist or take any or all of those actions. After 14 days they will only go after the fees. They will not accept phones back. I do not think they will return phones on EIP or payment plan either however I am not 100% on those phones on payment plans as TMO owns those as a secured loan so to speak. jet may know more on that then I.

    The only phones they will blacklist we already went thru in nuesem.
    1. Phones bought with fake information or fraud accounts.
    2. Phones bought and no 1st month payment of balance paid. (regular accounts)
    3. Phones bought with EIP or payment plan on new value plans.
    4. Phones used in a crime or being used against the law in some way.
    5. Phones stolen from TMO not phones reported stolen by end user. (YET)

    What is on the fence is if Asurion is blacklisting phones reported lost or stolen. Some say yes. Some say sometimes, some say no.

    Bud, Just wait till your contract cancellation period is over (14 days) to be sure. I would wait till last day in your current pay period as long as its over 14 days since your upgrades. Then by TMO own cancelation period contract as see above, you will be able to do what you want with phones and simply pay your early term fees. You have the proof as so nicely posted by poster above. No harm, no foul.

    I was thinking about that section of the terms and conditions when this subject was initially being discussed. However, it does say a new line of service, which technically existing lines would not be. I know that you can return upgraded phones in the first 14 days on an existing line, and have a new 2 year agreement backed off the account. However, I don't know that you would be required to return the devices within the first 14 days (or possibly be charged full retail price) as you would be if it was a brand new line.

    I agree Jet, I think both fall under this 14 day protection policy. Makes sense. Thanks by the way for testing an IMEI. That helps all too. Now we know we can at least have that protection to. I know not really OT but wanted to thank you.
