    For 51-year-old Faron Butler, the thing he cherished most after his daughter's death was being able to hear her voice.

    "Every time I had a bad day or just wanted to listen to her I'd go through my old voicemails," Butler told ABCNews.com through tears. "I had one that I'd play over and over again. She'd be saying 'Daddy, I love you and I miss you.'"

    He said he was shocked when a few weeks ago he went to hear that familiar voice, only to find out the voicemail had been erased.

    "I was going through my messages after a friend called me and was stunned when it said 'no saved messages.' I mean, my heart just stopped. It tears me up," Butler said.

    Butler's daughter Rhema was 12 years old when she was diagnosed with desmoplastic cancer. She died two years later, on June 6, 2011.

    Butler, who lives in Elma, Washington and has two other children, says he was offered a free trial of T-Mobile's "voice-to-text" service when Rehema's messages were deleted without warning. He says he called the company, asking them to recover the voicemails.

    Their voicemail system warns you over and over when It's getting close for a voicemail to be deleted and let's you save it again. I feel for the guy losing good daughter, but don't sue someone over a voicemail being deleted after a long period of time. Maybe he should sue himself for not recording it into something more permanent.

    Concurred... He definitely should of transferred the recordings onto something more permanent, but trying out that new feature apparently gave him no warning.

    I feel for the guy but I think bringing on a lawsuit is silly. Years ago my mother had old voicemails she wanted to keep so she put them on a voice recorder. If I had important/sentimental voicemails, I wouldn't leave it on the VM system - too many variables.

    I say the plaintiff is responsible to save the voicemail if it's important. ANY carrier does not have responsibility to save the voicemail forever.

    Tmobile should have given warning that the voicemail would be deleted when he switched to the new feature. I believe if the warning was given the farther would have taken the steps to preserve the voicemail. Shame on Tmobile.

    They kept the voicemail since June. The father should have moved it off, he had months. The visual voicemail app on android let's you easily move it off.

    You can't expect any carrier to save a, message for 9 months.

    And I feel for the man who sued AT&T for throttling his account down... people sue carriers all the time

    Agreed, also, t-mobile has no idea of the contents of the voicemails, so it's not like they have any reason to treat one account different than another. Maybe they should warn you that if you change your features that it may delete to voicemails, but you don't see people sueing the makers of cassette tapes cause they wore out and people lost their old saved messages.

    I'm starting to think that if I was DT, that I would want out of the U.S market too, if people are permitted to sue over stuff like this!

    I definitely agree that he should of moved them to a more permanent media, but the fact remains that Tmobile could of at least warned him of the deletion before proceeding. I bet if this happened on AT&T, you would be calling for blood, and by the way throttling(nor do I condone this)is fixable, retrieving permanently deleted voicemails aren't.

    Why not? Does T-mobile publish a 9 month limit in how long they will keep voice mail messages? I haven't seen it. Once again, T-mobile is taking actions against their customers without letting them know.

    Well now that it has been reported that T-Mobile is throttling Unlimited Total Internet accounts, even when the customer has the old T&C which does not mention throttling, hopefully you will support lawsuits taken by those customers against T-Mobile for that.

    honestly comeon man, the smartphone app lets you email the damn file to yourself so you have a copy. this is nonsense to sue over a voicemail.

    this is about as ludicrous as the person who sued mcdonalds because the coffee was "too hot"

    crazy people!
