I dunno what to do now - I liked the idea of saving $20 using that radio shack code but zero communication from them and an extremely poor website / order experience will have me check out best buy tomorrow. VM website says available 5/31 then when you click the "also available at these stores" it says 6/10. Don't remember if the radio shack site said anything but definitely didn't say 6/10

My RS order confirmation email says "shipping by 5/31", and I also saw a Facebook post from RS that yes they will be shipping on the 31st. I bet we get shipping confirmation emails tomorrow.

What a mess. Promise something to your customers, then back out because some legal issues weren't properly handled by the manufacturer. Another VM fail in the making.

not sure why pre paid would get the short end - it seems the pre paid market has the best profit margins

VM has nothing to do with it. As previously stated, Apple is causing trouble. VM doesn't run the customs border lol. If you promised a friend "I'll be there in 10 minutes", but on the way, a car hit you, it wouldn't be your fault that you'll be late. Same situation with Virgin Mobile.

Apple is constantly trying to sue every manufacturer. They're ridiculous.

So, it's after midnight eastern time, and still not available on the Virgin website. Will it be available today for online purchase?

It makes absolutely no sense, why the customs officials would block a phone, the HTC EVO V 4g aka HTC EV 3D they already cleared through customs last year. This phone should be out there today. I went to Best Buy last night and the guy hinted that they unloaded some phones. Hopefully, these are the EVO Vs. We will find out in 9 hours.

HTC One X and Evo 4G LTE indefinitely delayed at US Customs for investigation of Apple patent infringement

I couldn't find any reference to Virgin mobile's phone, maybe I missed it? Having bought the EVO 4G LTE, I went through the Sprint pre order saga and received my phone last week. I've never seen any reference to Virgin Mobile.

    Fishy.

They never took your money. They authorized it. You probably were using a debit card. A normal credit card authorization does not come off the balance and just sits there in limbo. However an authorization to a debit card (cash account) will come out. It can sit pending for up to 10 days. The merchant never gets those funds that are just authorized, the merchants bank just puts it on hold. Usually the merchant within that 10 day time frame will ship the product and will close the "batch" on your transaction. If the charge does not close on the transaction it will expire and the funds are released to back you.

"HTC has completed the review process with US Customs and HTC devices have been released, as they are in compliance with the ITC’s ruling. Future shipments should continue to enter the US and we are confident that we will soon be able to meet the demand for our products."

i could see that easily applying to a big order from htc factories with a bunch of different phones getting tied up while they make sure they aren't illegal in the states.

me 3 - my feeling is the shack too way too many pre orders to begin with and now possibly this customs issue has really screwed things up - I read the order it does say all new phones made by HTC w/Android are effected but they would allow refurbished phones through. HTC has changed their software to be in compliance one of the issues was clicking on a phone number in an email or a txt message and the phone dialer comes up. That is a handy feature hopefully they found a good way around it but kept that functionality somehow.

I guess the hunt is on for the phone - just wish I held off changing my plan until end of June - feel like I gave away $10 to VM.
