what annoys most is the fact that in november i did another and was billed what i expected, $99 +$35 activ fee, with this one is showing 219+35...
On the contract doesnt have have any star, no special sign around the price nor it says anywhere its that price after rebate. i wasnt even expecting any rebate, since didnt get one on my last HUP(november).

So then you should really be going back to the store you got it from to find out what happened.

What we can tell you is that all HUPs have a $50 rebate, so it's normal to be +$50 up front, and then you get the money back on I think the second bill after you upgrade.
Ironic that you spend as much time discussing the issue anyway. I don't think even you really believe that excuse.
This has nothing to do with "liking the price". It has to do with honesty, integrity and ethical behavior when it comes to simple things like pricing and advertising. As I said, it's really simple. Some people and some companies have lower standards for acceptable behavior. Thankfully others, and the law, have a higher standard.
I'll add that your comment is based on knowing what the pre-rebate price is. Funnily enough, that's sort of the point (hint:that's why there are laws...)

OP, is your contract hand written on a yellow carbon copy piece of paper or printed from an actual printer? Also do you have a corporate or regular consumer plan?

If so, another reason that retail reps shouldn't be "writing" contracts without contract law education.
Well I wouldn't necessarily agree with that. The contract is already written by Rogers head office, the rep just has to fill in blanks like prices and the name and address. My assumption is that this is just a slip up by an overwhelmed sales rep or he/she was new and didn't realize how Rogers handles hup pricing.
To the OP, if you don't want to spend time bickering either return the phone and reverse the hup and switch to another carrier to teach Rogers a lesson, or get a rebate form and mail it in and wait for your $50
If you feel like fighting it, call into the call centre and ask for a manger and offer to fax in a copy of your contract and they should be able to credit you back for the difference.
Either way, don't go back to the store and fight with them as they are powerless. They best they can offer you is probably a $50 accessory credit.
