I believe like apps, sprint can check for superuser access to determine rooted phones easily.

That was just a direct copy-paste of Sprint's TOS applied to Virgin's TOS. It even mentions roaming even though Virgin doesn't have any. (And won't be getting any.) So yes, even Sprint's TOS has the same lines about rooting. They basically imply that if you sneeze, they can cancel your account.
There's no way for them to tell you've got a rooted phone unless you abuse the service. (Tethering on a phone and exceeding your quota month after month) The policy bit is more of a CYA due to the EVO bringing tethering for $15/mo and the iPhone coming to the service (jailbreaking for being able to use it off network with someone else)...

Even ICS checks for Root. Whenever you enable/disable the Google Play Movies, system asks for SU access. You can't buy movies if it detects root. Just a tiny step forward for Sprint to make the My Account app (which can't be disabled without root even through ICS) check for root and report.
Not to take this thread off topic but i gotta ask. Wasn't a presidence set when someone sued apple over jail breaking Iphones and won? Is jail breaking Iphones the same as rooting Androids?

Its essentially the same but the case has no effect on rooting. I doubt they'd do anything about it, too many people root and I doubt they'd want to risk angering such a large community.

cpc, maybe maybe not. ICS was the first with these drm measures that require blocked root access. If they have software, for instance their own music player their, that required DRM to be intact or the contract is void then root would undermine virgin mobiles software DRM and thus void the contract.
Yes, but shootings been around forever and have they ever done anything about it? No. Also rooting by itself doesn't delete any of VM's apps. I'm taking my chances, OV without root is pretty bad.

I am really liking the Triumph. It's better than my Optiums V in pretty much every way. I downloaded a new keyboard so I now have predictive text and I downloaded an app that is supposed to help with the GPS problem. I don't like that I can't draw perfect circles or lines unless I draw very lightly on the screen and I don't like the fact that the button to get the screen to turn on is on the side of the phone. I also do not like the touch sensitive buttons. I liked the actual buttons on the Optimus V much more. Draw something always crashes the phone too. Never had that problem with the Optimus V. Overall though, I think I will be happy with this phone enough to where I won't have to try rooting it.
If you like the stock Triumph, I suggest reading, learning and then take the leap to modify it. I have just installed the newest "Sharp" rom and it rocks! GPS almost instant lock, battery life better, MMS is now functional and camera app way better. This is how the Triumph could have been. If it was released like this I can honestly say at least half the detractors would have not existed. I moved up from the Inept I mean Intercept so I was happy with the Triumph stock with this rom it is night and day.
