Hi,
When you purchased the phone from the seller were you informed of and did you agree to a $10 warranty fee? If not, it's not part of the express agreement between you.
Also there's an implied agreement between a buyer and seller for all purchases you may make. Take a look at the following link which summarises the Sale of Goods Act in British Columbia. There will probably be a very similar act (possibly identical) in your province.

When I originally bought the phone, there was no warranty processing fee. I even had a warranty repair processed in November or so, on the very same phone, and it was free. They changed their policies since then, which is unfortunate, but it's $10, I'm not going to throw a tantrum over that.
What DID irritate me, as I said, was the first store wanting to charge $25 - this was the former corporate store at Yonge and Wellesley, where I processed my last warranty repair. They then sent me to a different location, claiming that they were a "Service Centre" and could do it for free. The place they sent me to was, really, NOT a "Service Centre", but when they asked for the $10, that sounded like the correct fee, so I just paid it and went on with my life. Now I have to wait a month to get a third Panache. I'm so excited. #sarcasm. #firstworldproblems.
Well I just got my 2nd replacement today after waiting 5 weeks, and now I have no idea what to do with it now since I have my Amaze. Let's see if it somehow breaks again.
That's too bad buddy..mine has been going for almost a year...and I found a new Panache for the wife around April. We both have extended batteries...HTC offline GPS...sweet...
She hasn't told me a thing about the phone going bonkers; like as if she will even notice.
I'm totally geeked out with this phone considering the extended life batteries are sweet.
I'll probably get us two s3's when our phones crap out. The s3 is the only other phone that Mobilicity carries that you can buy a decent bad a** extended life battery for...

Well having bought the Panache in January and then going through 2 warranty claims a month apart from each and each of the claims lasting for about 6 weeks, I am happily content with my Amaze, and now not knowing what to do with the Panache I just got back yesterday.

I unlocked the Panache and I was experiencing this problem too. I thought it happened because I unlocked it and the call dropping issue was a result. I've noticed that it is starting to get a bit slow too.
My signal drop was bad too, but I think it is because cell towers do not respond well at all to toggling of data on/off or to devices getting out of range and back, which I doing a lot of with JuiceDefender.
I am on the T-Mobile Mytouch4G ROM, with radio fully flashed to match. I don't use the Sense launcher, and have several minor tweaks I made to the stock ROM like overclocking and memory management. I actually really like this phone.
Development is not really that active on this phone. We are leeching off other similar phones like the Desire HD. Most of the developers have actually moved on.
Which extended battery did you get? The phone is pretty heavy as it is...

I tend to believe the occasional blips are, most likely, from a virgin carrier as in Mobilicity or Wind. The HTC My Touch 4G was one of T-Mobile's best selling phones... And the 3500 ma extended life batteries that power both of our phones are priceless.
I Googled for extended life batteries for the other phones that Mobilicity carry (generic or otherwise). The Panache or MT4G extended batteries I notice in abundance; I can't say that for the other phones..

Update: I got my Panache back! Not like I'm not DYING to replace it with something new, but I think that'll always be the case. Since my warranty expired at some point in the last few days, after (if, when, etc...) this one putzes out, I'll get a new phone. Maybe by then the new iPhone will be out, and will work on AWS? (Optimism...). Or all the new Nexus phones. Who knows.
When I was there, my friend happened to be changing to Mobilicity (from Rogers) - and he bought the Galaxy Nexus - his first smartphone! So I'm giving him tips on how to use it while being extremely jealous. Hah.
