I'm sort of iffy on this, but in the time it will take to get an answer you could very easily activate the maxx, then activate your old phone again, thus pushing the maxx off and guaranteeing a problem free sale.

Do I have to activate a RAZR MAXX LTE that I bought using my last unlimited data subsidized upgrade before I sell it? I already agreed to the contract extension via the automated phone system. I know you had to with regular 3G phones so that the buyer would be able to activate it.

you don't activate 4G phones
I have this same question. I'd like to sell them sealed. I didn't know 4G phones have SIM.
I can speak for what I did about two weeks ago.
I had an upgrade, I ordered the RAZR Maxx online through verizonwireless.com, activated it online, then reactivated my old thunderbolt. I sold my RAZR Maxx on ebay and I never opened up the phone to insert the SIM card or anything. I think because my phone order was tied to my Verizon account, I just had to select whatever was there. Once I accepted the contract online, I just reactivated my old Thunderbolt phone.
However, I did run into some problems since the SIM card I had was a regular sized SIM and my RAZR Maxx SIM was a microSIM. I didnt know that it deactivated my regular SIM(even though the rep told me it would be fine).
I tried to use my microsim in my Thunderbolt using an adapater but they couldnt do it over the phone(said the SIM was incompatible with my phone). In the end, I ended up going to the Verizon store and they gave me a new SIM for free. It didn't work when they first did it so I suspect that there was a problem with the way they activated my thunderbolt. It seemed like 3g was working fine, but 4g wouldnt work. They ended up having to do some fiddling to get my 4g activated. I was of course a little concerned about them fiddling around in my account since I have unlimited data, but it ended up being just fine.
So my advice is when you get your new phone, activate it online, accept the terms of the contract, then reactivate your old phone but expect to make a trip to the Verizon store preferably before you sell the phone just in case there's a problem.
I just listed the phone as new and never used. The box is shipped opened already so it's not shrinkwrapped anyway. I took a picture of the phone in the box without the box cover for the auction.
Probably not the answer you were hoping to hear, but that's my experience. I haven't heard from the buyer of my phone so I'm assuming everything was fine on that side. My suggestion is don't give up the SIM card that comes with the phone.
Did you figure out a good solution? I am in the same boat.
Several lines I have new 4G phones but I want to continue using the 3G phones. If I switch it over to the 4G devices even for a minute, the 3G ones would need to be reprogrammed. Since the people who have them are all 20-1200 miles away, I rather not kill their phone and hope they can follow the simple programming instructions.
Plus on the other old lines, have a standard size SIM.... So don't want to go driving out to find a VZW store either.
