If this question isnt allowed warn me mod. Ok lets say i report my phone destroyed crushed. I pay my deductible receive my new galaxy s 3 fyi the first galaxy was payed for and the second is too. I use the second one and give the so called destroyed one to a friend. Can the friend just pop in their already tmobile sim and use the first without problems ?

For the exact amount, call the provider. You haven't provided much details as to whom your phone insurance provider is.
I know some don't want the phone back if the phone is reported as lost or stolen (duh) and won't charge extra if that is the case. Wrongful claims are fraud, though, and it may be possible the provider may blacklist the phone (again, contact the provider).

Wink wink i know its fraud....... But whats if its a phone that fell of the freeway........ Crushed by many cars ........ Oh and tmobile is the provider.
